So yes im a bit of a brain fart and need someone to explain to me what im doing..! i try reading all these forums but im just confused as to whats right now.

I got my husband to call a military helpline for visas and guess what!!...They dont know what the CR-1 is.

We have been married 2 months tomorrow and filed NOTHING :angry:

Who decides if we are applying for the K3 or CR-1? I thought we do but i somehow read that ''they'' chose the CR-1 while filing the I-130 or something like that :wacko:

Is there anyone who could send me a PM so i can get in contact and ask questions because otherwise im going to be in germany forever :unsure:

you decide what visa you want...

Either spousal visa process begins with the I-130... plain and simple... you want a spousal visa you need the I-130.

If you only want the IR-1/CR-1 visa then the I-130 is all that is needed to start...

If you want a K-3 then you would file the I-129F in addition to the I-130... Most people nowadays choose not to do the K-3 route as the I-130 petition approvals have sped up quite a bit compared to just a few years ago where there is only a small difference in overall processing times and the overall cost for the IR/CR visa is much less

FWIW, the difference between the IR-1 and CR-1 is the age of the marriage at the time of visa issuance... the processing is identical and it is at the time of visa issuance that the consualte decides IR or CR... Marriage less than 2 years old = CR, Marriage more than two years = IR

Thank you so much for replying i really appreciate it. Do we have to note it anywhere that we are applying for the CR-1 seen as for the CR-1 and K3 you have to file the I-130. How do they know what we are after?

nope.. no designation required at the petition stage

the difference between the IR-1 and CR-1 is the age of the marriage at the time of visa issuance... the processing is identical and it is at the time of visa issuance that the consualte decides IR or CR... Marriage less than 2 years old = CR, Marriage more than two years = IR

They will know IR/CR or K-3 based on whether they have the I-130 petition case file or the I-129F... because in a K-3 situation the I-130 can stay stateside and only the I-129F goes to the consulate...

ahhh i see! thanks. Also quick question on the G-325A..I worked as an aupair in england..it was privat and i left on bad terms, i dont even think they live there anymore as they are military and i was only there 4 months. Do i have to include it? i cant even remember there address.

employment references are not checked... fill out the info as accurately as you can remember

FWIW, in addition to the case file they have they can also tell which visa by the visa application you submitted... If you submit the DS-230, I-864, et al and paid your application fee of $400 to NVC (National Visa Center) then it is IR/CR.

If you submit a DS-156, et al and pay a visa fee of $131 then that is K-3

2 questions:

your profile says you're from the UK; but you mention you live in Germany. So my questions are:

1.- Do you reside in Germany? of the UK?

2.- Do you live with your husband abroad?

The reason I ask is because if you live together abroad, you might be eligible for Direct Consular Filing - which results in a CR-1 visa.

So you're a military spouse? If he is in Germany, go for DCF! It will be so much faster - I think it's done these days in around 3-4 months.

Just follow the guide for DCF, and get his paperwork from command (employment letter, LES, I-864 only at 100% of poverty line for military personnel) so you have it for interview.

If you have questions, feel free to ask, we've been through the same thing 3 years ago (my hubby is also military).

Military help line is for expediting citizenship, expediting petitions or specific military military/family questions. They really dont know much about the visas or anything related to that kind of stuff. - we ran into the same problems. we got some very rude people on the phone from there too. The on base immigration people that are free gave some good advice to us, might help if you guys or your husband can talk to them too.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

i see some military people replayed. yes go to base and find out what help is there and have them walk you through the process. also many military people here that will help you out also

also remember your husband has to start any process he is asking for you to come over. even thouhg you are married he still has to ask.

enjoy live with him and this is just one more step we all choose in marring somebody form diffent country.

i think you learn the person so much more. and set up better line of communication.

He could call back and ask about the visa under its correct name: Immigrant Visa (for an Immediate Relative).

If you are both living in Germany, he should be able to file the I-130 at the USCIS Field Office inside the Embassy (aka "DCF" or Direct Consular Filing).

I live in germany because my dad is in the british army, im dual national..my mum is german. I see myself as british but i have both passports.

My husband is in the states, he was stationed here in germany but PCSd back to america in january.
