Well, since you stated that she's of legal age to marry with parental consent, you're probably going to have to get statements from her parents saying that they're okay with her marrying you. I'm not sure if you should get them notorized or not, I dont think it'd hurt.

If she's two months away from turning 16, I'd wait till she's 16 to file. It might make it less complicated.

Like Rhiann said, wait until she is at least 16. You will face an uphill battle. Do you have enough income to sponsor her?

I do, yes. I believe I meet all the petitioner qualifications to bring her here, however I haven't gotten very sure-footed answers from legal consul regarding her age and whether it's an issue. The most positive advice I've been given it to try and see what happens. We have her parent's approval to marry and the means to do so; our only hang-up is legally being able to live together in the US. The K-1 seems to be the answer to that issue, and perhaps you're right about waiting 'till she's 16 at the earliest to file...

It would probably make sense to go to the city/county clerk's office where you will get your marriage license to learn what they will need to see in terms of parental permission for a non-US citizen. Better to know early so that you can prepare properly.

Hey, for your FYI what you are doing is ILLEGAL. you are an adult and she is an underage GIRL!! can't you figure that out? I got a great idea why dont you date someone of LEGAL age? or wait till she is of legal age? But maybe those are hard concepts for you. I don't know. Smells like a Troll

Hmmmm.... I would think you'd HAVE TO wait to apply until she's 16 or whatever the legal age is, since you both need to be free to legally marry at the time of application (unless I've forgotten a lot in the past few years - which is not impossible).

Unless you find something on the website about the legal minimum age, I'd recommend calling USCIS directly.

That's an interesting question - since each state sets their own 'legal' ages, what do they require on a federal level? Also, the legal ages in other countries might be different. I guess people would have to check if they were (or thought they might be) close to any 'cut off' ages.

People are assuming that he's had sex with her already. It's none of OUR business if he has/is or not, but we shouldn't assume he has. Even if he has, and even if it's illegal, it's HER concern and HER PARENTS' concern, not ours. Oh, and his (if he got caught and prosecuted). It's quite possible he's waiting until it won't be an issue. Maybe that's one reason her parents consented, for all we know - that he is gentleman enough to wait.

What all of them are or are not doing, and why, doesn't affect any of us (other than, for example, freaking me out as I realize how close my daughter is getting to the "age of consent"! I jokingly told her that her first date will be the day after my funeral). Trust me, the parent in me wants to rant as well, but there's also the part of me that remembers being 15/16.....

My concern would be is she ready to get married? She's the one that's going to get grilled about it at the interview and not her parents. I understand this may be more of a cultural issue, but it will be up to you to prove that both of you are able to legally get married within 90 days of the VISA.

You do BOTH need to be able to legally marry at the time of application so definately wait until she is 16. It is not worth getting a failed visa application on your file just because she is under age as it just causes you more work in the future (and this process is work enough at the simplest of times)

My advice:

Wait until she is 16

Make sure you give loads of evidence of an ongoing relationship (Photos of you both with both families, phone records, emails etc)

This can be a stressful process and you are likely to get it tougher because of your fiancee's age, so make sure she is ready for what is ahead. She may be mature but it is unlikely she has had this kind of stress before. So make sure she is 100% happy to go ahead and that she is prepared for what lays ahead.

It might be worth getting some legal help with your application, that way you have someone to check everything and do the chasing for you if there are any problems. Most of the time I would suggest not worrying about legal help, but under these circumstances I think it would help you both.

While you are waiting for your fiancee to turn 16 start getting your proof of ongoing relationship together. Make sure you have both visited each other and spent time with each other's family (Take photos)

This girl is too young for you. SHe asn't even really gotten to understand herself, let alone some older dude. You really need to rethink this buddy. What if things don't work out. Better yet, what if the INS loks at that and decides to take you in. Sure, its legal over there, but I can assure you that's its not legal in the least over here, and you really should think about befoer you get registered as a sex offender, for just marrying a young girl.
