Hi, ok I have this question...

Which is the procedure as an Inmigrant living in U.S.A. to get married with an American Citizen?

Is enough just go to the court and get married?

After that what's next? where to go? have someone have been in this situation?

Thanks for the next answers, the help and take the time to read this topic...

God bless!

In order to enter the US to live with your husband, you'll need a visa. Since you are currently unmarried, you have choices.

Is the person a legal immigrant? If so, then they would get married (church, court, Vegas) and if needed apply for any adjustment of status.

If the person is not a legal immigrant then it's a more complex situation.

do you mean 'immigrant' or 'illegal alien' ?

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

How did you enter the U.S.? On what visa? Was it EWI or did you overstay your visa?

If EWI, then you can forget about it. Just go back to your home-country.

since you entered illegally, on what grounds can you adjust status, when you have no status to adjust from?

Lin, you are making your case even more complex than it had to be. You guys were denied a K-1. That is already in your immigration file. The only way to regularize your case is to get married, go back home and file for a CR-1 (or a K-3). To do otherwise would be to intentionally circumvent US immigration law and I can guarantee you no one on VJ will advise you on how to do that. And of course, USCIS will not look kindly on you doing so.

Do not make your life more difficult than it needs to be. Marry, go back home, begin the CR-1 process. Best of luck.

by entering without papers, you have created yourself a mountain to climb. if i remember correctly, your i-129f petition never made it to the embassy, and was denied by USCIS in the beginning. so you will have a lot of explaining to do if you do plan on "adjusting status". you might want to invest in a well-qualified immigration attorney.

buenos suerte! you are going to need it.
