Question- My husband and I have had a rocky marriage due to personality conflicts but both of us love each other and want to remain married and work it out. Now last year I applied for a K-3 visa for my husband and it went all the way up to interview. He had his interview in Dec and was told to come back after getting a DNA test for our duagter. To make a long story short we had a disagreament again and it spiraled into months of arguing and no real attempt to move forward. So here we are in Dec again and we are talking of trying to get it right this time. The embassey told him last year there was no time limit on when we brought back the DNA evidence and since then he has moved and we have not heard anything else from the Embassey. My question is will we be able to submitt the DNA test next year in Feb (money reasons) or has the I 129 expired? If it has expired is the I-30 still here in the states and can we just pursue that instead or do we have to start ALL OVER???? I am confused as to what step to take next. PLease I need advice!

Dont want my thread to get lost with no answers- anyone, anyone? :whistle:

If I were you, I'd call and ask. NVC usually closes a file when nothing has been done for a year.

Removal of Conditions: 12/09/2011

ROC check cashed 12/15/11

NOA1 12/13/11

Biometrics 1/6/12 Complete

RFE 9/13/12

RFE package sent back 10/17/12

Card Production Ordered 12/04/12

10 year card arrived in mail 12/10/12

Unless the I 129 was reaffirmed by someone then it dies 4 months after the approval. You should be able to contact the embassy to see if it is still active. Maybe they placed it is a suspense file if you are lucky

This will not be over quickly. You will not enjoy this.

Who requested for DNA for your daughter?

NVC or Us embassy at the time of interview and when did you carry out the DNA

i believe your best bet, as someone mentioned earlier, is to contact nvc. your i129f is most likely expired. but NVC will know if you will be able to continue on with your I130. good luck :thumbs:

Thank you all who replied to my question. I was figuring I needed to call someone but wasnt sure who. SO I need to call NVC. Ok will do that. I am also hoping that even though the I-129 is expired that I will be able to continue with the CR-1 otherwise I will have to start all over.
