Hello everyone, I just wanted to ask something regarding my mom's case...

My Aunt, who is my mother's sister & a citizen, filed a petition for my mom many years ago.

My mom was in the Philippines at that time but later got approved for a working visa here in the U.S.

Right now we only have a NVC case number regarding my Aunt's petition.

Recently, my mother received a letter from NVC which is asking her to fill up the DS3032/Choice of Agent.

Also, my Aunt/Petitioner received an email from NVC asking her to fill up the I-864 and pay the $70 fee.

We are now clueless on what is happening right now regarding my mom's case.

Any advices and help will be much appreciated :thumbs:

Maybe I didnt understand it well, but if you received Ds 3032 choice of agent, and you guys still want to immigrate then you should fill up the form and appoint you agent as per form received, pay the fee and go on, what is that you dont understand?

I think the situation is that the mother is now here in the US instead of the Philippines. This makes it an unorthodox case.

If you're mother is in the US legally then all she needs to do is go back to the Philippines when the interview is scheduled. The NVC will schedule the interview with the embassy as soon as they receive all payments and documents they've been requesting (AOS fee, DS-3032, etc.). If the visa is approved, which it probably will, she can use it to come back to the US and enter the country with her new visa.

BUT, if your mother's work visa has expired and she's still here in the US, then the current visa petition will be denied at the embassy given the fact that she stayed here illegally. She would still have to go back to the Philippines for the interview.

it's left USCIS and made it to NVC, and NVC is moving along with it's process.

Another thing is, her employer filed for her Labor Certification, til' now, it's not approved yet.

If she waits for that Labor Certification to get approved, and adjust her status here in the US, it will take several years for my mom to get a GC.

She filled up her choice of agent already and she put her address here in the US.

Will the NVC schedule her interview here or in the Philippines?

Do you think that she need to go back to the Philippines while the case is being process? or just stay here in the US?

No matter what, your mother will have to go back to the Philippines for her interview, it will not take place here in the US. And again, if she has legal status in the US, all she has to do is go back to her country for the interview and come back using the new visa they'll be issuing if approved. If she is out of status, meaning she does not have legal documentation to be in the US, she will still have to go back for the interview and then she will be denied.
