K-1 Visa - Overseas Wedding???

if you are legally married in Portugal then you are legally married for US purposes..................

Is it ok to come to the US already being married in Portugal? And just use the marriage certificate from their as our proof that we are married. That wouldn't require the K-3?

Oh that won't work at all, you have to be legally able to be married, which is not possible if you are already married. I'd just wait, there can be severe consequences if you do that.

I agree. It's better to be on the safe side. Dani and I wanted to do the same, but we decided against it. :yes:

Does anyone know if it is possible to do any type of transfer, or change the already "opened" K-1 and file a CR1? I know its a long shot, but I'm not made of money and would like some of my $455 back if my K-1 is useless, lol.

Sorry, as far as I know you cannot transfer or get the money back... You have to file the CR1/I-130 which includes paying the fee again...

Sorry, as far as I know you cannot transfer or get the money back... You have to file the CR1/I-130 which includes paying the fee again...

It is not possible to transfer a K1 application to any other visa type. You will have to abandon your K1 application and then file for a CR1 visa paying the appropriate fee's again.

You paid a petition submission fee, not an approval fee... it is not the fault of the USCIS that you might have petitioned for the wrong visa ...

i am not saying to do any marrage. but the whole thing is the ceremony reconized by the gov't of that country? if so you better not do it. if not who would know a quiet ceremony for the family there. but that is only if the gov't mandates a courthouse type of ceremony normally found in formor communist countries

No you wouldn't get a K1 and a CR1 - why would one person need two visas?

I am in the same situtation, we marry in a small catholic church in vietnam but not legally register to marry. My wife show the consulate of our wedding ceremony for the k1

visa interview, and was deny to be sent back to NVC. We thought it would be ok just for a religious cermony. Would my wife be ban to U.S.? I am so worry now I love her very much.

Should I consult Attorney? Any attorney recommend? how much the cost . I am in florida.

This is why any hint of a 'ceremony' prior to receiving a K1 visa is a BAD idea. Esp. when you call it a marriage!

None of us can say whether or not she will be banned from the US. I guess it depends on whether or not they feel she misrepresented herself as a fiancee when she was actually married. It's quite possible that is how they'll see it, which I believe would indeed trigger a ban.

Yes, consult an attorney. Immigration law is federal so you do not need to have one that is in Florida. Costs vary - many will do at least a free consultation. www.aila.org is a good place to start your search.

The K-1 is for unmarried couples. You got married. Period. Simple. Very clear. You became married which means you are not unmarried; you are married. The K-1 is for unmarried couples. If you marry, then you must use the CR-1 or K-3 visa. Very simple.

I understand that the reason for the K-1 Visa is to bring your foreign fiance TO the US to marry you here. However, is it possible to have the marriage there (Portugal) first, and then just sign the paperwork here? I know its against the law to be married twice, but is it still if its the same person in 2 different countries? We decided to start the K-1 Visa process so we could get a head start rather than waiting the extra time until we were married, then filing for a K-3 visa. Anyone have any thoughts on the options we may have? We would like to have a ceremony in Portugal, then come to the US to file the paperwork within the 90 day limit. Anyone with help or advice would be a savior!!

What if you have a religious ceremony, but do not get a civil wedding? Could you have a ceremony at a church and not fill in any paper work or get legally married in either country -- why would this be a problem?

It's not really that simple, it depends on the country and their laws/regulations governing religious ceremonies. I would ask in the regional forum with people that have experience specific to you situation. The vietnam group on here is really active and i'm sure would be able to answer.
