I´ve been living illegally in Europe, cant get Police Certificate here.

Chica Yeye ... I am continually amazed at the posts you put up. Where people are looking for hope ~ you are telling them things like "be prepared for it not happening" and "you should have left Spain the moment you were denied the residence card." I'm not saying anyone should give false hope ~ but there is a way to say something with tact and compassion ~ you don't use either. I don't hardly ever post on VJ because of people like you. You seem to have an answer for everything and you don't seem to have any compunction in the way you deliver your message. I don't know Karina and her husband ~ but it seems as if you are trying to scare her and make her feel worse than she already does. Maybe you ought to step back once in awhile and ask yourself, "am I going to help this situation at all?" BEFORE you post. Just a thought.

Karina, I wish you and your husband the best of luck in this journey. Is always hard to be seperated from your love for any length of time ~ especially when you're not sure when the seperation will end.

IIRC there is a user, chris4336, whose fiance was able to get a visa through the consulate in Spain while living illegally there. I would contact her or do a search of her posts.

If this is the only hope I don't see much of anything else.

I plugged in "chris4336" into VJ search and it came up empty, nada, zippo.

I think your husband should start looking for work in Bolivia.

That is one of the .. hardest words I´ve heard in my life... U should thank God EVERY DAY u didnt have to get this situation, u have no idea how I feel, Life is not fair to everyone, but one day u r up, next day u r down. I leave all this in God´s hands.. HE only knows Im a good woman and I deserve to be happy.. with my husband.. I´ve waited for him all my life!! lucky u... u r happy now...

Why? I'm an American who lived in Bolivia and I LOVED it! I was in Cochabamba and I'm not kidding you that that was the best year of my life.

If my husband would agree to move back with me, and I had a good job, I'd return.

here in Spain, when I got my resident card denied, they also told me I can apply again..and Idid!! but it can take many months to be aproved!

OK, this entire thread is kind of mind boggling, but it sounds like you are living in Spain in some sort of extralegal rather than illegal manner. (Yeah it's a fine point, perhaps something like going out of status in the US, whatever.)

I think a lot of people have jumped the gun on the seriousness of this situation. If you have applied for a resident card, the Spanish government clearly knows you are there and is not deporting you. It must be a different situation in Spain than it would be here.

I would explain it exactly like this to the interviewer: You have applied for a resident card in Spain--show that paperwork if you have it including any acknowledgement from the Spanish government--and the Spanish government will not give you a police report until the resident card is approved. IF you can get something written from the Spanish police refusing the police report, show that as well. Good luck. I think you will be ok.

As I said before, when u get denied here, u can apply again, and again, and again until u get it! right now I am waiting for my second answer, this is not USA, I can get my resident card but is gonna take me I dont know how long time! I dont blame anyone! of course no! but NVC told us to send an explanation letter and we did! I just want to know if someone has been in this situation and what happened to him or her! that is it!

I think what you're saying is that you are trying to get your Spanish resident card so the CR-1 process can go forward.

I hope you succeed in that. In your favor you will have your marriage to a USC and documented intention of leaving Spain.

As long as your intention is not to stay in Spain, there's no reason they should hold you back.

Let's hope your husband is willing to be supportive while you deal with the bureaucracy.

It's reasonable to expect that he may have to return to the US before you

(has he already done that?) because of the exigencies of employment.

I did say before that he should look for work in Bolivia but that was flippant on my part (my bad)

but you have to sort this out with the Spanish authorities if that is possible while keeping the

consulate informed so they can adjust deadlines accordingly.

Best wishes - it's a challenging situation yes but I don't think it's hopeless.

Well. Duh. Of course you loved it. You earned in a first world country and spent in a third world country. That's a bit like Kim Jong-il taking a peek out of the palace window and saying, "What do you mean life is hard? I love North Korea! It's fantastic!" :unsure:

If... I had a good job, I'd return.

Why?

You could always sell tortillas from a cart! Still think you'd have "LOVED it!"?

I don't mean to be so hard on you, but your comments were extremely ethnocentric and out of touch with the realities of life there.

Not everything floats on hope. Sometimes people need a reality check. I'd rather be told, "These are the problems with your case and this how you can deal with them" rather than a blanket, "Oh sweetie, everything's gonna be fine! Don't you worry your pretty little head about it."

Also, you overstayed your original visa. Sort of like being out-of-status. A little different from entering illegally. I'd follow Toma's advice.

FINALLY I FOUND SOMEONE IN MY SITUATION!!

Hey,

Yes, we were in that situation. My fiancee, now husband, was in Spain illegally. I will write more tomorrow as I just got home from work, but in short the embassy told us that we did NOT need to get a police certificate (since these are impossible to get if you are illegal). All they said my husband needed was a permenant address in Spain where they could send the immigration mailings. The interviewed him and issued the visa with no problem.

I will have more time to write tomorrow but my biggest advice is talk to the embassy in Madrid. EVERYONE on this board, lawyers, even the USCIS told us he would have to go back to Algeria, his home country, to get the visa. It was NOT TRUE. The people issuing the visa are the ones in Madrid, so they are the ONLY ones you should get your information from.

Don't panic - we got our visa as an illegal in Spain fairly easily.

What are the specific details of your situation if you don't mind me asking

I can see they got their fiance visa, im married!! well, I called to the US Embassy here in Madrid and a nice lady told me to call tomorrow which I will of course! she also told me she can´t see any problem if I get my interview here, since Im living here... about the police certificate she told me.. it cant be a problem...

I really hope to get better news tomorrow!

Yes I did!! Thank u a lot! it is so helpfull to us!! Im gonna send her a message explaining my situation and she will contact me later today! I also called US Embassy here and I really hope to be able to get my interview here! Operator told me it wont be any problem! Anyway I will know it for sure tomorrow afternoon.. but the point is.. THIS GUY WAS ILLEGAL HERE GOT HIS INTERVIEW APROVED HERE AND NOW THEY ARE HAPPILY MARRIED THERE! THAT IS GREAT!! Thank u God for giving me a break.. and hope!!!

Thank you. I agree that if someone has a question they should by all means post it. The whole point to my post yesterday was "THINK about how you come across when posting" ~ not asking anyone to change their answer ... just asking them to stop for a moment, read what they have written and maybe choose different words if at all possible. When someone is worried and scared and going through this process, the last thing they need is people jumping all over them and attacking their character or their intelligence. And it DOES happen all to often on here. I think this website and the people on here, have a wealth of knowledge to be shared with others. I do. I think it has, does and will help many many people through this visa process. In the year and a half that I've been on here, I have watched countless people post and get a barrage of comments, suggestions and opinions that were down right mean at times. I think many people reply to a post with their opinion and not with facts. I just wish that more people would use a little tact and compassion when replying to a post and if they don't absolutely know the answer ~ they should either refrain from replying or make sure that it's known it's their opinion.

YES!! Tomorrow Im gonna call to the US embassy here in Madrid, if they tell me I can get my interview here it would be great!! Cant tell more now... I can´t wait until tomorrow! If someone got this situation before, they applied for a K1 visa (fiance) and he even living here illegally was approved, so I have a chance! Now they live in the US... is great they did it!

There must be more people like me in this journey, I wish it to be helpfull to them...

tact and compassion are lovely in proper context, but useless in this case.

trouble is, this case is not unique. there are lots of people out there who might read this thread that may be affected by what is written in it. therefore, what is written must be truth in it's rawest sense. people need to be warned of the consequences of violation of immigration law, as such can affect their lives in ways they would not expect. they must be warned not to violate law, as violation of law often results in reduction of rights and priveleges.

too many people on this board think that illegal immigration is not a crime, and that it should not be punished. they are foolish, and need to be reminded that America is a nation based upon law, interpreted without respect to persons and privelege as is so common in much of the rest of the world. it is this very feature of America that makes it such a great place, and yet so puzzling to those from other countries.

You can be truthful and have tact and compassion at the same time. You don't have to be rude and disrespectful when trying to give advise to someone.. Why kick someone when they are down?? America has ludicrous immigration laws in my opinion. It seems to be much easier to cross the border illegally than to follow the rules and regulations set forth by the NVC. They make it almost impossible to get a visa.
