Ok, this is not the I-485 Instruction page, but a page on this Visa Journey website, if you can show me where on I-485 Instruction page it lists "Marriage Certificate" I'll believe you... but thanks, now I see where people are getting their checklists from...

We used these guides on websites just as that, guides... However we read and followed the oficial instructions from USCIS that came along with each application thoroughly, they're very clear and list precisely everything needed to send along with each application, so I don't think I'll have a problem or RFE (hopefully!)

Ah yes, but we're in the Adjustment of Status from Work, Student, & Tourist Visas section here, not K1

15. Evidence of Eligibility:

A. Based on Immigrant Petition (thereby attaching I-130, not a marriage certificate as with in the case of 15 B...)

I just don't want to have people worried if they did not submit an extra copy of the marriage certificate with I-485, if you're not adjusting from K1 it is not necessary and not required as per the I-485 official instructions...

I sent all my stuff off to USCIS on November 4th, and I also didn't attach a marriage certificate to I-485. I went through those instructions with a fine-toothed comb, and I never saw anything suggesting I had to send a copy. They surely can't give somebody an RFE if they haven't specifically asked for something in the instructions!?

I certainly haven't received an RFE yet.

And, as for sending off a certified copy of my marriage certificate, I just made a simple black & white photocopy. Once again, the instructions said that would be sufficient.

On the other hand, my bio appointment letter didn't mention anything about bringing along my marriage certificate but someone told me they will turn you away if you've changed your name but don't have a marriage certificate to explain why the name on your immigration paperwork doesn't match the name on your ID. No idea if that is true or not, as I took mine along to be on the safe side.

AUGUST 10 2004 - Arrived in Austin, TX with F-1 student visa status.

EARLY JAN/FEB 2008 - Met Michael (my future husband) in the café where he works.

APRIL 12 2008 - We go on our first date. It lasted 2 days!

APRIL 13 2009 - Got married in Marfa, TX, in the middle of the West Texan desert.

NOVEMBER 4 2009 - Finally saved up enough money to send off I-130; I-485; I-131; I-765.

NOVEMBER 5 2009 - Package arrived at the Chicago Lockbox at 9:32 a.m! Signed for by A. Analakis. [DAY 1]

NOVEMBER 12 2009 - Cheques for I-485 and I-130 are finally cashed! [DAY 8]

NOVEMBER 12 2009 - I-485, I-130, I-1765 & I-131 are all "touched"! [DAY 8]

NOVEMBER 13 2009 - Received NOA's for I-485, I-130, I-765 & I-131 (Notice date - November 10th 2009).[DAY 9]

NOVEMBER 16 2009 - All forms were "touched" again. [DAY 12]

NOVEMBER 23 2009 - Received biometrics appointment letter (scheduled for December 14th 2009) [DAY 19]

NOVEMBER 24 2009 - Walk-in biometrics appointment in Austin ASC [DAY 20]

NOVEMBER 24 2009 - All forms were "touched" [DAY 20]

NOVEMBER 25 2009 - All forms were "touched" [DAY 21]

DECEMBER 28 2009 - Received AP approval letter, dated December 23. Received a text & email, too [DAY 54]

DECEMBER 29 2009 - Received email & text, saying EAD is approved; card production ordered. [DAY 55]

DECEMBER 31 2009 - Received AP document. [DAY 57]

JANUARY 2 2010 - Received EAD & interview letter (interview will be 02/16/10, San Antonio). [DAY 59]

FEBRUARY 16 2010 - Approved at interview! I-551 stamp in passport. [DAY 104]

Thanks Dirtyweebesom... just wanted to clear that up as we did, like yourself, go through my AOS application with a fine tooth comb and I was pretty sure we sent everything as required.

yes it's always good to be on the safe side I'm sure, nothing wrong with putting too much evidence together I guess, but my personal opinion is that I will just send what they ask for (as per the instructions with each application) and how they ask for it (legible photocopies and originals when required) and I reckon it must be annoying for the person checking the paperwork, giving them double duty as they have to go through each piece of needless bit of paper to get to the stuff they actually need...

I actually think the guides on some of these immigration community websites can be a little confusing and too general, not specific for each different case, so it's better to use it as a guide but to follow the official instructions thoroughly instead, they're pretty clear and easy to understand once you've read it a few times over, lol !

Like my grandmother always told my sister: "Don't ever say you can't cook again, it's not the cooking that's the problem, it's the following clear directions that is" lol

I have also sent photo copy of marriage certificate and not the license. However the IO asked me the marriage certificate at the time of interview. I shown her the original marriage certificate but she said I don't need this and I wanted the one given from court. So I gave her the marriage license. I didn't have the copy of the license so she took the original.

I assume and sure what they are asking you is the marriage license. Please try sending the copy of marriage license it doesn't harm anything. Good Luck.

On I-485 instructions pages it does mention about "submit copies of Marriage Certificate" search on I-485 instructions for word "marriage" and it will show you.

We're Adjusting Status from Work, Student, & Tourist Visas section here through marriage to a US Citizen - we're beneficiaries of an I-130 petition.not K1 !!!!!

Please read PAGE 5 on I-485 Instruction page, link:

For Evidence of Eligibility there are 4 categories:

15. Evidence of Eligibility:

A. Based on Immigrant Petition: Attach a copy of the approval notice or submit complete relative petition. (NO MENTION OF MARRIAGE CERTIFICATE!!!!!!!!!!!!!)

B. Based on admission as the K-1 fiance of a USC and subsequent marriage to that citizen: Attach a copy of the fiance petition approval notice, A COPY OF YOUR MARRIAGE CERTIFICATE, and your Form I-94

C. Based on Asylum status - no marriage certificate required

D. Based on continuous residence in the US since before January 1, 1972 - no marriage certificate required

The only category requiring the submission of a Marriage Certificate for I-485 is adjusting from K1 visa. If you're adjusting from K1, you're in the wrong forum, this is the: "Adjusting from Work, Student & Tourist visas" section

If you're adjusting from Work, Student & Tourist visas the Evidence of Eligibility is:

15. A - Based on Immigration Petition - attach I-130 approval notice or complete I-130 to I-485, no seperate marriage certificate necessary for filing I-485, it's included in I-130!

Please make 100% sure before you post advice on here as your post can lead to confusion fore people who filed correctly following the OFFICIAL instructions !

Sigh, we've been through this before. This forum is NOT for people who are changing status from a family-based visa. Yes, the I-485 instructions do say (on p5, 15 - Evidence of Eligibility) that K-1 fiancé(e)s who subsequently got married to a USC need to submit a marriage certificate, but this does not apply to any of the people on here. We're all adjusting status from work, student or tourist visas.

Forgive me if I'm wrong, but I don't see anything about us having to provide a marriage certificate/licence.

ADJUSTMENT OF STATUS

OMG Dirtyweebesom, I'm so sick of this issue... some people definetely need a lawyer if they cannot follow the clear instructions that come with every form...

All I can say is maybe we should do a thorough F1 to AOS checklist, coverletters and the works and ask the moderators of this site to pin it, the instructions on this webpage way too general, only for "filing if your spouse is within the USA" no mention of what type of visa the spouse is on!!!! what with all the "certified" copies, marriage certificates and all....? What do you say, we have some time to kill, let's do a new thread, and call it "F1 to AOS through marriage to USC, 100% correct instructions" lol

I totally agree with you guys - the instructions on here help - but they definitely need updating. I think the forms do too - I used forms direct of USCIS but I read of people using forms of here that are expired.

Also the instructions on here still say to send 4 copies of each G-325a... This hasn't been the case since the new form came out months ago. When I sent mine in I read and re-read the USCIS instructions on this and did some research and found posts verifying you only need one copy for each spouse for I-130 & 1 for the immigrant for I-485... Yet I still read when people get an RFE and state they only sent one copy of each G-325a - posters telling them that will be their RFE - so not likely! I've yet to read of 1 person getting an RFE for additional G-325a's.
