can i apply for a touristic Visa when im under CR1 processing Visa and my papers are at the NVC??im asking this cauz im so tired...my wife is refusing to send the affidavit of support the I-864 and things are getting so bad with her...anyone can help???

You can certainly apply for a visa. As there is a CR1 petition pending you may find it more difficult.

You can certainly apply for a visa. As there is a CR1 petition pending you may find it more difficult.

well guys this is what is going on....after the problems start with my wife was the time when i met an american girl that we are in love right now...im here in tunisia and she is there in USA...and when it sucks with my wife..we really dont know what to do really..we cant wait mercy from my wife to send the affidavit of support cauz it is beeing more than 8 months when she was suppose to send it...so is there any legal advice...to resolve all this mess.....we are tired too much

Get a divorce and start a new visa process with your new girl.

divorce i know about this..but it is going tobe long long step like that...divorce is going to take at least 1 year with this situation...im in tunisia when she is in usa..the process is going tobe too long..and after that prepare for new marriage and it is going tobe years for me tobe there..it is really fraustrating....GOD

It's called life. If you are really serious about this new woman; you want to do things the legal and right way. Your wife can and should perhaps withdraw the I-130 right now.

This is one of the many reasons that you spend plenty of time getting to know each other BEFORE you get married.

The bottom line is that you have to get a divorce, then start the process again. You can't come on a visa to your wife when you know you aren't going to stay together. It is fraud.

I am confused. You married an American and the American that you are married to filed I 130/ CR 1 visa for you. Currently you're at the NVC and the next step is that your wife needs to send it the I864/Support papers and she is not sending them. You've met another American and you want to be with her? Can you please clarify if that's what you're trying to say.

If that is the case you will need to divorce your wife in Tunisia (where the marriage took place) This can be done in 6 to 12 months in Tunisia. You can file for divorce without your American wife there. You just have to get the papers from the beladiya (where you were married) and file based on abandonment.

You would then have to start the process again with the current American girl you are talking to. As others have stated you can apply for the tourist visa, however it won't be easy to obtain. You'd have to prove your financial and family ties to Tunisia ( that you own homes, cars, have a job, have money in the bank, etc) and also overcome the doubts in their minds due to the fact you already have/had an immigrant visa in process.

Are you stating that you want to continue the CR 1 process with your current wife to come here and then be with the new American girl you've met?
