Leaving Canada next month

Man, was I ever confused in thinking my tax returns would be so easy, then.

I thought, leaving before December 31st meant I would only have to worry about filing for 2009. Not being able to switch my Canadian DL to a US one is going to bite me in the butt though? Oi..

I think this is all getting far too complicated. If you have investments in Canada, are withdrawing RRSP's after you leave the country, feel you could be a deemed resident and want to claim back tax you might incur on your EI (if you claim it) - then it might be a bit tougher - but even then it's not that complicated.

Having your Canadian driver's license is just one thing on a long list of things that determine residency, it doesn't stand alone.

Thanks, trailmix, I obviously read that wrong. And you are right, if there is no income, there is no need to file a tax return. We ARE overcomplicating this situation, and I certainly did not help :whistle: .

ENP, for 2009, you were a resident for the entire year, and you were a resident on Dec 31st, so you only have to worry about filing a Canadian tax return, and you do not include your fiance's income. NEXT year is going to be the tricky part.

You don't actually have to fill out that form, really it is only for people who are having trouble determining whether they are residents are not - you submit the form and they will let you know.

Next year shouldn't be too tricky for EnP really, she will not have any Canadian income, therefore she won't need to file a Canadian return. If she works in the U.S. then she will have to file a U.S. return only. Becoming an actual permanent resident of the U.S. - ie: they hand you the green card, does not determine residency for Canadian taxation purposes.

Well said above....I may have sounded crusty too...perhaps because I've been at it for a while. I would suggest people go back and read the tax threads in the Cdn forum...ultimately the CRA will decide whether you're still a resident based on the information you provide. You want to be as accurate as possible so that they make the right determination for you. If they are in doubt - they'll send you a letter, don't you worry :)

I liked doing my taxes back in Canada...it's just the first year or 2 when you move where things seem dicey as to what you should file as .....if that makes sense. I received EI in the 1st year I was here so 2008 was actually my last Canadian Tax return...not 2007 as I had first thought (when my job finished and I had moved)

This year will be my first where I do not file a Cdn tax return - YAY me!

do i grab a tax return for both can and quebec in advance or do i just change my adress so that they send me the letter in the USA or is it simplier to leave it at my grand mother adress and just ask her to mail it to me ?

OR do i just pick 2 and bring them with me....

OR since i won't work i just send my T4 to the person that do my tax return in canada (telling him i moved to USA) and thats all ?

i don't care what happen next year i just want to make sure i won't get sewed over it if i do something wrong..

just tell me what i need to do now before i leave... i quit my job on the 30th that leave me 1 week and a half to settle up that Bull*** lol

I'm not sure if you are having a tax preparer do your 2009 return?

You are not quitting your job until the 30th, so there is nothing you can do before that. When will you actually get your T4? I doubt the company will hand it to you before you leave, they will probably mail it to you in, say, February.

If you want a tax preparer to do your Canadian taxes this year, you will probably want to go and meet with them before you leave. Then either you or your Grandmother can drop off your T4 slip.

If that is the the extent of your earnings this year - 1 T4 - why not do it yourself, lots of good software online to do it - I personally use ufile.ca - so simply give the company your U.S. address to send your T4 to, when you are ready, do your return online.

By doing it online, if you have your netfile number you can just file online - if you don't have a netfile number you can just print out the return and mail it in.
