Hi everyone!

My Wife and are splitting up. We got married in December and lived together up until October when we moved to different places. Things didn't work between us very well and now we a re thinking about filing for a divorce. We live in New York and next week I'll be moving to California since I got a job offer.

My question is, what happens with my status if we get the divorce and what are my changes to get the 10 year green card since we are not married anymore.

I'd appreciate your help!

You should be able to file to remove conditions yourself, as long as you can prove that the marriage was bona fide. Make sure you get copies of any documents that show you intermingled your lives : joint bank a/cs, joint lease on your home, health, life and car insurance, family plan cell phones, joint names on utilities, etc.

And don't forget to file BEFORE your CGC expires, but no more than 90 days prior.

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017

Hi thanks a lot for the response. My CGC expires on 5/22/11. Should I wait until 2/22/11 (that's 90 days prior) to file? I can't do it before that?

you have to file immidiatly when u have ur divorce decree...every lawer suggest not to wait until the 90 days period starts
