My husband got his visa approved last week. I applied for him (K3 Visa).. We have been married for 2 yrs now... My question is when we go to US will he get a conditional green card or the 10 yr one.. I read it some where that if one has been married for more than 2 yrs upon entry to US u get the 10 yr green card... Is that how it works? Or do i have to file I 485 first and then he will get the 10 yr green card? Can somone pls clear my doubts or give me a site where i can get this information...

Once he moves to the US and you apply for Adjustment of Status, he will get his card; not before that.

Once his Adjustment of status goes trough, he is likely to get the 10 year card, since you guys will be married for more than 2 years then.

:guides:

How long does that take? I will be living in California..

It can take anywhere from 6-12 months after filing. This is why it is highly recommended to file for an IR-1 visa instead of the K3.

Please Read the Guides, they will answer most of your questions. It takes months --- 90 minimum for the EAD and the Advanced Praole to come through.

K-3s do not need Advance Parole for travel after applying for AOS.

So first he will recieve his conditional green card then i will apply for his 10 yr green card right?

If your husband arrives to the US with a K-3 visa, he will need to apply for AOS to get his PR status/green card.

If you have been married more than 2 years when his AOS is approved, he will not have the conditions, and will get a 10-year green card.

Dear god. We have told you about 5 times what you will need to do. You will Adjust Status, and once that is approved he will get his green card.

You say you read the guides, your responses show different. You should do a bit of research yourself instead of expecting people to answer all your questions.
