Not sure if they issue RFEs after an interview (I thought they do it during) but I would think if your case was being reviewed by a senior CO and all that was missing was a co-sponsor, that they would just send an RFE for it. Don't know about police checks but I would assume the same.

Thank you, this puts my mind a little more at ease. I think I'm going to call the DOS line tomorrow and see if they can tell me the interview decision -- that might clarify things a bit. The courier service doesn't have our tracking number on file yet, but it's only been 2-3 business days, so maybe things will be all right after all. Fingers crossed.

Great, this fills me with dread. Why wouldn't they have asked for our co-sponsor forms then? Did they let you know somehow that you weren't going to receive it? What happened?

My intention was not to fill you with dread, more of 'expect the worst, hope for the best' just in case...The co-sponsor forms, if they're needed, will be asked for and all that happens is a short delay - it's more the arrest and visiting on the VWP that's the issue. There's a whole, rather long, thread on Brits who've have a really hard time for just the same sort of thing, and based on their experiences it's unlikely that a visa will be issued so quickly.

I was so excited when I was approved - tied up all the loose ends, said my goodbyes, booked a flight for six weeks later...it was only after two weeks had gone by when I still hadn't got my passport back and called the embassy to see if it had been lost that I found out I was in AP. It'd have been much easier to cope with if I'd known earlier, let alone if I'd expected it.

Oh, I know you weren't fear mongering or anything, it's okay. I was aware of AP and the waiver list and everything, but thought that since they told us we'd been approved, we were in the clear. However, I was not aware that people in AP had been told they were approved at the interview as well. The one hope we have is that we've since learned (via his subject access report) that the crime that sparked his arrest was NOT classified as a CIMT, so I'm going to keep holding on to that sliver of hope until we hear otherwise.

I'm going to call the DOS line as soon as it opens today and see if I can find anything out, but it might still be too early since the interview was only 5 days ago.

I just called the DOS line to see if I could find out our interview results. The woman was very kind and said she could see that he had attended the interview, but it still takes anywhere for a few days to a few weeks afterwards for them to check up on everything before the visa can be issued. I said that they'd told us he was approved at the interview and were just wondering how soon it would be sent out. She sounded sympathetic. Maybe I'm reading too much into things, but I remembered Dodi's post where she said she could hear the woman smiling when she said, "Not long now," so I have to assume this woman can see something about our status that I can't... something about the way she said, "Good luck" at the end made my stomach drop. I am officially back to being gripped with fear and dread. I am terrified.

Any news on your visa? And thank you!

Nothing yet... we're still within the normal processing times of it being approved and sent, so there's nothing we can do at the moment but wait. Yesterday was very panic attacky, but we've tried to calm down and hope for the best and be ready to prepare for the worst. It's just the not knowing that's the worst... it was so amazing to finally have a few days of joy after these past 7 months of living in limbo, so it's heartbreaking to be back to that again. Hopefully we'll hear something soon. Thanks for asking.

What?? I'm sorry you've already withdrawn the AOS, it limits your options pretty severely...no use crying over spilled milk. :( Just follow the CR-1 guide, I guess. Don't do the K-3, because it's a waste of time, and could possibly even delay your petition further. Good news with the CR-1 is you won't have to adjust again, he can come in as a green card holder.

Thank you to everyone who has commented, and for your support and suggestions. I mis-typed in my original posting. Ryan hasn't actually withdrawn his AOS application, we were just advised that we needed to do so before it got denied, as having it denied could potentially have negative effects on our I-130. We have been searching for a lawyer to help us with this, but it has been a nightmare to find someone who has even dealt with it. I guess living in Los Angeles, immigration lawyers aren't used to dealing with legal immigration.

So, if we haven't withdrawn the AOS application or sent in the I-130, is there something we can still do with the AOS? We were informed by someone on the USCIS info line that because Ryan left without biometrics we are basically screwed. Although, every time I call them, I get a different answer.

I was also wondering if anyone had any experience with expediting their I-130. I was wondering if, because we have already had the I-129f ane K1 visa approved, that maybe that is cause for expediting us. We have already had our financials checked, Ryan's medical and immunizations done, police report cleared, and interview done. Doesn't that count for anything?

If anyone has any information they can share, I am soooo grateful to accept it. Thanks again you guys, this forum has helped to keep me sane and at least keep me somewhat hopeful!

Just got wonderful news: called DOS again, and the woman said, "I have good news for you: his visa was printed today and should be delivered in the next few days!" WHOOOOPEEE! We are so relieved and happy I could weep.

Shara, I am going to ask that this issue be moved to it's own thread in a more appropriate forum where maybe some others can help us out to get you some answers and hopefully make sure that you don't have to be apart if you don't need to!

I am not sure if it will work for you, but from a "they-can't-say-yes-if-you-don't-ask" perspective, I think you should gather any documents you need to show that he needed to leave in an emergent situation and schedule an INFOpass where you'll take them in for him and see if they can expedite AP on the existing AOS application. They can get the documents to the embassy and he can get them to try to come back to the US that way. Gosh, he's been gone for nearly a month, so I hope it's not too late. However, it's FREE, so no harm in asking.
