I have a tenure greencard and got divorced. If I am going to re-marry here in US do I still have to secure a CENOMAR (Certificate of No Marriage) from the PI?

I would not think so. CENOMAR is if you have never been married. I think you would need your divorce decree instead.

Nope.

If you were originally married in PI the first time you should get clearance eventually from the Philippine government as you will be committing bigamy in their eyes.

If your ex divorced you in the US you will be OK but if you divorced him you'll have to get a annulment in PI to be clear.

Yep, its 10 yr. and we've got married in the Philippines. Do I really have to get an annulment back in PI or only Petition for Recognition? It does confuse me though.

did u got ur divorce decree here in u.s.? if yes u need to give that in phil Em for updating even ur married in PI ..

May. 2011 --- graduated for my bachelor degree

I had often wondered how they would know who initiated the divorce...I suppose with the divorce it would have a defendant and plantiff? Either way it is a mess. at least she has the 10 year greencard.

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

YEP, and the problem is I was the one who initiated it. As what i've understood after I did it that the Philippine government would only recognize it if its the foreign husband who institute the suit.

You are free and legally able to marry in the US if you have a US divorce. Does not matter if you initiated it or not. You also do not need to get a CENOMAR. What you do need is a divorce decree.

It is a different matter altogether though if you plan on marrying in the Philippines. If divorce was initiated by US citizen spouse, you need to have the divorce decree recognized and annotated in your PI marriage contract before a PI marriage license can be issued to you. If divorce was initiated by you, then you will need to get an annulment in the Philippines.

Having said that, again, if you plan on marrying in the US, you don't have to worry about having the divorce decree recognized or having to file for annulment. You are free to marry anytime in the US.
