Currently we are filing for AOS. Papers go out tomorrow. I see where the AOS must be filed within 1 year of arrival. Somewhere I had seen that some forms must be completed in 90 days from nonimmigrant's entry into the US, under a K1 visa. Any help?

Thanks

The K1 finace(e) is out of status after 90 days. You aren't required to file within that time, but filing does protect their status if it becomes an issue.

Also, along with the AOS you can file for the EAD which would allow the spouse to work legally.

The info above is not quite correct. The K-1 visa specifically requires the holder to have married and file for adjustment of status within 90 days. Few people are actually penalized if they do not file within that time frame, BUT you are required to do it. It is dangerous to spend time in the US without legal status. Don't hesitate to file those papers on time.

As of yesterday, my wife is out of status. I lost my job 3 weeks ago and we are just making ends meet. I can't afford the $1010 for filing and don't know how long before we can. She really wants to work but understands that she can't till she gets a green card.

If any one has an idea what we can do, please let me know,

Thanks
