I am gonna claim my Husband this year, although I was married in 2008 I called the IRS and was told to file head of household married but could not claim him since he did not reside in my household for 6 mos or greater. So this year I can't wait to claim him $$$$$ I need to change my name tomorrow @ SSN I dread this because its so much involved in changing of the last name, but Hubby is not happy bout me not taking care of it so that's on my priority list!

Now I am starting my research for the I-751 to remove conditions woooh its only 485.00 and I hope that doesn't go up any time school but I won't count on it. Making my cover sheets now, I want to be well prepared and gather evidence along the way. I was getting nervous all you guys doing AOS and having medical issues just wanted to make sure we are ok there. The other day I was cleaning out the hall closet and found my Husbands chest Xrays from the medical LOL we lugged those all the way to the States trying not to bend them and they didn't want them at the POE .

One good thing now fee to change the name on the passport

ok yardies i have a question a friend is adjusting statusof her husband from a work visa and the lawyer is jerking her around she needs a co sponsor the co sponsor has questions and the lawyer wont answer them where can she direct the co cponsor to get questions answered

Thanks Nat, Bunz, JQ, DW, Shemmy and anyone else i missed thank you all i paid the bills so i'm just waiting on them to show PAID so that i can get my cover sheet and my hubby is going to get his PC express service next week Monday or Tuesday and my AOS package is ready to go

Mawning Yardies

OK so we just submitted the AOS payment last night and the DS-3032 by email and i wake up this morning and my $70.00(AOS FEE) was gone from my account so i call to find out if about the AOS and was told that the DS-3032 was accepted and the IV VISA Bill($400) will be sent in 24-48HRS ok now i am in shock since they told me it takes 2-4 weeks for DS-3032 to be accepted

I'm surprised about that. I just did a lot of research and found this:

Choosing Resident Alien Status

Nonresident Spouse Treated as a Resident

Well, that wasn't entirely conclusive, so I called the IRS International Tax Law hotline (215-516-2000) to ask. Joseph told me that

If I file a joint return: (so I know I can file one)

1) He'd be considered a resident alien for tax purposes

2) He needs to report world-wide income, converted to USD

3) We need to attach a statement signed by both of us containing two things: a declaration that he chooses ot be treated as a US resident for the entire tax year and our contact/ID information. The details are in that second link, or on page 10 of Publication 519.

They're in the guides above. Basically, you file for 3 things: AOS, EAD, & AP. It cost $1010 to file them together. You'll need the detailed tax information to go with this, as well as a certified copy of your marriage license/certificate.
