Hey!! I'm new here and i hope i wrote this on the right area...

anyway, i'm a j-1 student from guatemala and i wanted to know if i'm going to have any trouble marrying my boyfriend (he is a US citizen) since my program here is about to end. we've been talking about getting married for some time now but we never find the information we seem to need... all the information we get is about K1 or K3 visas, does that means i have to go back to my country and then come back here with a k1 visa?

please help!! :wacko:

Hi knche and welcome to VJ :star: My husband is from Canada and he also came here on a J1 visa. We were married in August and we filed for Adjustment of Status (AOS) following the guide that Otto & Karin provided for you. My husband's J1 doesn't expire until March 2010 but if you do get married and your status runs out, it will be forgiven since you are filing through marriage to a US citizen. You will want to file ASAP after your marriage though since you won't be able to work legally until you receive your EAD (Employment Authorization Document, form I-765). Once you get a handle on the path you want to follow (although I highly recommend AOS as it allows you to stay in the US with your SO while filing...whereas the K1/K3 require you to leave the country for a while) feel free to continue posting on this site as its members are full of information to help!!

01/14/10- Interview completed - Approved!

are you talking about the 2 year rule, that says i have to go home for 2 years regardles if i marry and so? acording to my DS 2019 im not subject to that, but the weird thing is that my visa doesnt say anything about it, i mean it is on my DS but not on my visa would that be a problem?

Do you mean it's not listed on your I-94? My husband's on a J1 and he has the DS-2019 which also states he's not subject to the 2 year requirement. His I-94 says nothing about this though. Those are the only two papers he has for his J1 though. We just sent in photocopies of his DS-2019 to show he's not subject to it and so far we haven't had any RFEs!

In my case it says on the visa and DS form that i'm not a subject to 2 years residence back home.

But it is totally fine that at least it is mentioned on DS.

knche-As long as you have it written somewhere, ANYWHERE - you should be fine.

I had it written on my visa and on my DS form and it was one of the questions I had at the AOS interview.

Does anyone know how to get a replacement DS-2019. I was in the states on a j1 and need the ds-2019 for evidence but i cant find it!!!!!!!!!!!!!!!!! Also, mine did say i was subject to the 2year homestay rule, but i have since discovered that was an error on their part as the uk is not subject to that rule. thanks in advance
