We are not speaking of misrepresentation. We were speaking of being involved in prostitution and not being arrested.

Until a person is arrested, it a moral issue and not a legal one. Ask any judge. Until the law is invoked, its not a legal issue.

Yes sir, in my opinion....if i have been engaged in a prostitution, and wasn't arrested..then I wouldn't have proofs in NBI or any police records...then I can escape that question easily....(just correct me if imwrong please...hehe)

That is a legal issue. To do so ("escape" the question on the DS-156) would be breaking the law.

If she was not arrested of prostitution, she is free of not answering the question if she has been engaged in prostitution.

Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty or other similar legal action? Have you ever unlawfully distributed or sold a controlled substance(drug), or been a prostitute or procurer for prostitutes?

note that it does not ask if one has been arrested for prostitution. it asks if one has been arrested or convicted of any offense or crime.

the part about having been a prostitute or not is a yes or no, not a maybe only if arrested.

Read her post again...she said IF SHE HAD.

Either way it doesnt matter.....I think this thread is losing what the OP was intending. It will be his decision to persue further or what have you. You cant tell me that there arent "bargirls" that have never gotten a visa and engaged in prostitution....

It just all depends on how you look at it....yeah the bars are like pimps. In the end it is up to the OP to make the decision to still try for the visa. Yes if she did engage in prostitution, she would be ineligeable for a visa even if the visa doesnt directly ask about it.

it's a good way to get a suspension as it's against the tos......

Being suspended for TOS violations is FUN happened to me I wear it like a badge of honor :D. my thoughts to you is pissing off a moderater a day keeps boredom away. :devil:

Would you get involved with a hooker here? Poor is no excuse for prostitution. Most everyone there is poor.

Hate to be the one to ask, but have you considered being tested for stds now?

yeah im going to have myself tested on MONDAY, I feel violated

if she did what she did before you met her, and she still told you about it now, it means she jsut wanted to come clean about it.

now if you test positive for STDs now and assume it's from her and still feel love for her, then don't change a thing.

if you feel violated and betrayed later, the next step is up to you.

remember, it's how you feel deep inside that should matter

1 : to offer indiscriminately for sexual intercourse especially for money

I offer that even a bar girl does not offer indiscriminately and so as such, does not meet the definition of prostitute.

And because of this can answer the question, NO.

If USCIS meant that a 'bar girl' was not allowed a visa, then they would have stated such. They did not do so.

What they did, was choose words that have an amount of 'fudge factor'...

By your logic, if we call a prostitute a chocolate sundae, then they are no longer a prostitute. There really isn't much to debate here. "Bar girls" are prostitutes.

i think everyone here knows better than to try to "fudge factor" given the potential for a lifetime ban. i'd appreciate it if we don't have an exercise in semantics.
