I was married in August. And my husband had entered under a visa waiver. Yes, it was intended for us to get married. We were under the impression we could! Now after being married and I find out differently. No, he isn't in the U.S. A week after the wedding he went back to England. This was his fourth time coming to the U.S. visiting with me. On this last visit, it was a few weeks after he arrived that we wedded. What do we do!? I didn't realize we were committing any fraud! We had NO intentions of him staying and applying for a change of status of visa. We thought once we wed, he'd go back to England and we would start filing form I-130 and whatever else would be needed. I'm just so lost! Help!! What should we do? I feel so stupid!

Relax, you didn't commit any fraud. This is a non-issue.

You're fine since your husband returned to his home country. Now you may file a I-130/I-129F for him.

No need to be worried!

It is not illegal/ fraud to get married in the USA while on the VWP or a tourist visa. What is illegal is getting married with the intent of staying, but your husband didn't stay, he went back to the UK. Thus everything is legal and you guys did the right thing, that is a bonus if anything in the visa process!

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
