AOS Filers: December 2009

Wow you sound like you did even more than us up front. I also attached a "dear adjudicator" letter to the I693 vaccination stuff just as a reminder that this was for a K-1 and that a full medical was not required because the visa medical could be found in the existing A file.

We got back this nonsensical RFE about our medical being there, but out of date (it absolutely was not!). A very sharp lady from our congressman's office emailed the congressional contact at the national benefits center (that's MSC) and got it all cleared up.

I found it quite easy to get the congressional inquiry kicked off. Just call the different local offices for your three reps, ask to talk to the person who works with immigration cases, and tell them what's up. If you feel comfortable with how well they understand/how helpful they are, you go on to the next step (probably should only do with one) which is to fill out their privacy forms and request in writing that they look into it. They gave us the option of fax, mail, hand carry etc. We finished up with emails. Really, the hardest part was just calling all of them - once I got to the staff lady who helped us, it was easy breezy.

Nik+Heather, how long did it take before you heard something back from the congressional inquiry? We're hoping to hear something before our infopass appt on Feb 3. Hoping we don't have to make the 4 hr drive to get to the USCIS office.

I think that many people are getting the RFE because they only send in the DS3025, and don't do the CS transcription. One filer has gotten the RFE for the vaccination portion specifically - not the whole medical. We got a bogus RFE, and now that it's corrected we seem to be going along smoothly with ONLY the vaccination portion of the I693 sent in.

There is another change around that time frame which might be responsible: In the winter, flu vaccinations become required. - This is a change from the TB suspicions because again, we seem to be going along fine now without that.

I would recommend that if you get an RFE, you should first have one of your senators or your congressperson initiate a congressional inquiry. It's free, and it works for some situations. AND it elevates the issue. I was really surprised to hear that the immigration helper at one senator's office had NO CLUE about these issues. Probably because no one calls to tell them!!!

I sent a request to my senator's representative today. I will continue with the process of getting his medical exam done but in the mean time if we receive an answer from the representative then of course we'll stop the medical process. Hopefully, we'll get an answer as soon as you did and a good answer  . One thing he didn't have done was the flu vaccine. That could be the problem with ours. I just wish they could be a tad bit more specific as to what the problem is .

Well, after calling to get the best prices on the immunization in my town, we made an appointment for yesterday morning. When we were at the appointment, they told us that they didn't provide MMR or Veracella for adults and that we would need to go to the District Health Office. That's fine, but I wish they would have told us when I was asking about the shots and making an appointment. Just more money out the window. Our appointment with the CS is on February 8 -one month after the RFE was issued. We'll send it out hopefully that same day.

Hope everyone is doing well!

I wonder if there is some confusion over date formats... the one used here in the US is not the same as used in a lot of other countries.

U.S.A. style date format (mm/dd/yy) vs the European style (dd/mm/yy)

That was my first thought. Then....We checked. There could be no confusion - "April 28, 2009". I mean. Really. Just no way that sort of mixup could have been made with the way the dates were written.

The VJ Immigration Timeline is estimating that I'll get EAD/AP next week. I wonder if it'll be accurate for us at this stage of the game.

When we filed the I-129F, the timeline estimate on here was off by 2.5 months, saying mid-April when we didn't get approved until early July.

I know, I get up every day and its a routine. I check the website two or three times a day, I literally watch for the mailman. My honey was off today so he told me I needed to get out of the house so he took me for a drive and we got to go to a Kmart. I love Kmart, we use to have them back in Canada but they close them all up. So we roamed around there and then went out for dinner. It was nice but my mind was still on the AOS. I will be so happy when I can get out to work. That, and go back to Nova Scotia and get my stuff out of storage. Nite everyone, lets hope tomorrow brings some news.....even a touch would be nice.
