John, you need to realize that what works for you does not mean it will work for everyone else. Fred went in and made a scene and it DID work for him. I am sure that I can list many people that just waited the 60 days that it did NOT work for. To the original poster, John's method did work for him, and he is trying to help by offering advice. Just remember that each case is different, what worked for John might work for you or might not, each case is different, so before taking any advice, just remember that you have to live with the decision that you choose. All we can do is tell you what has worked for us or for others that we know. You can go and make a scene if you want, it might work, it might not, you can sit and be quiet and it might work, it might not. The choice is ultimately yours to make

John, that is not what I was meaning, your advice is helpful to people, I just want people to know and understand it is their decision to use or not use advice, this way if you or any of us tell them what to do and it does not work, we don't have to look over our shoulder because they are mad at us and trying to hunt us down for revenge.

How is life in America for you and your wife John? I hope she is adjusting well to her new life. Good luck for you in 2010 as well

Thank you all for your reply's. Jeromhbinh said "they have 90 days from any submittion of evidence to reply" Anyone know for sure about the 90 days? I am here in VN awaiting a reply from the consulate. Its been more than 65 days since I gave the papers to the consulate.

It is up to the CO.. it can take far longer than 90 days... Fred is a good example of how long it can take... it should be 60 days or so.. have you gone to the consulate recently to inquire?

No I haven't been to the consulate lately. I have been living in Hue, about 400 miles from HCMC, so its not easy for me to go to the consulate. I have Emailed them 2 times and the response they gave can be read in my earlier posts. I have also tried to call DoS with no luck from them either. I really don't know what else to do but wait?

Last time I checked, it was about $80 RT on Vietnam Airlines.

JetStar has only one flight per day each direction between Hue and HCM. The Hue to HCM flight is at 10:15am, and the HCM to Hue flight is at 8:20am, so you're spending the night in HCM if you take JetStar.

Vietnam Airlines has only a few flights per day from Hue to HCM and back. The first flight from Hue is just after 8:00am, arriving in HCM about half past 9. With a little luck, it might be possible to get to the consulate in district 1 and get back in time for the 12:20 flight back to Hue, but the Saigon traffic gods would really have to be looking out for you. More likely you'd have to take either 5:00pm or 6:00pm flight back.

If he needs to visit the consulate during the US citizen petitioner's magical visiting window between 3:45pm and 4:15pm, then he's spending the night in HCM. It would be almost impossible to get through the consulate, get back to the airport through Saigon traffic, check in and get a boarding pass, go through security, and get on the last flight by 6:00pm. He'd still probably need to get the 8:10am flight from Hue to HCM. The second flight of the day arrives at 2:30pm. Getting out of the airport and to the consulate in 1:15 might be possible, but I wouldn't count on it.

In other words, you pretty much have to count on burning up one or two days for a five minute visit at the consulate.

Also, the Hue airport is located in Phu Bai, well outside the city of Hue near the coast. You have to get up pretty early to catch that 8:10am flight. The 4-star hotels in Hue start serving breakfast at 5:00am for that reason.

It has been well over 90 days, and we plan on going to HCMC on March 1 to ask why its taking so long.I have been living here in VN for almost 6 months awaiting a response from the consulate. I hope when we go they give an answer, and not tell me they are reviewing the papers and wait for a reply. I don't want to wait any longer. Someone said Fred went in and made a scene. Can anyone tell me more so when I go ask I can try to do the same? Thanks.

Hi Anh bob, 121 days of AP here. Only way I can rationalize it is to think their terribly inefficient, actually are busy and backed up, and its been either an American or Vietnamese holiday since November. I have to think that after TET things will start to move again.

Right around the 60 day mark for us I went to the consulate, spoke to a CO everyday I could and was only told your case is waiting to be reviewed, please be patient. I also submitted more evidence and asked if doing so would add additional time to their review, she said "it could". So I dont know if my "60days" of review start from the time we were put in AP or from the time I submitted more evidence.

I thought about the making a scene tatic but decided against it at this juncture. To me its a win or lose all move and Im not ready to alienate the co and staff there yet.

Anh Bob,

I talked with Fred, what he said was that he only wanted to speak to a supervisor, and that it was his right to do so. He just pushed the issue that he would wait there all day if it took that long just to talk with the supervisor. This is basically what I got from the conversations we had. hope this helps Jerome and Binh

Hi Anh bob,

Tomorrow, 7th Dec, your wife can bring the blue slip to the next appointment. If you already submitted it on 13 Nov, your wife can print the scan and go to the embassy as schedule. They will give you an answer.

Good luck and hope your wife will get PINK tomorrow
