Hello, we are new in the forum and just about to fill out the the papers for the K1 visa. The examples on this page are extremely helpful! We have a few questions though and hope someone can help us or guide us to the right topic on this page.

1. I-129F,

Question 18

I have met my fiance 9 years ago and have seen him so many times in the last two years. Would one sentence like that be enough for the answer? Or how is the answer best to fill out? How should the additional supplement page look like? Is there anywhere an example form or an example text?

2. G-325 A

Employment last five years

We were both students, and worked on and off for many companies, and I graduated last september and worked for many language schools as a teacher. How exact has this to be filled out? What is if I am a teacher and kind of selfemployed/ a freelancer?

1. What I'd do. I'd answer somewhat like you did, but I'd add more details. You *can* tell your story going back as dar as 9 years, but you have to show evidence of having met within the 2 past years. That's the important part. As a supplement, just take an extra sheet of paper, add the number of the form and question, and put your name on it. On the box where you're supposed to type information on the form, make it clear that there's a supplement to it.

2. I think you've answered your own question. Just list all the jobs you've had, doesn't matter if you had them for short period of times. As for the freelancer part, I can't help, since there may tax stuff involved I don't know how to deal with.

I only offer advice - not even legal. Just the plain and simple kind.

First off decide whether you are self-employed or not. You need to be more explicit than 'kind of'. How do you report your income for tax purposes? When working do you pay all of your own social security in full, or does another entity pay the 'employer's share' on your behalf and withhold your share?

If you are self-employed, working as a contractor, you don't have to list all of the individual assignments you've performed.

Thank you very much for your answers. does anyone know why they want the information of employment? do they check it? I used to be a student and work just for a year now, so I payed taxes just in one job, because the others where only for a few hours so I did not have to pay....

Your question is a good one, a better one would be why G-325A is still in use - it's an obsolescent form.

Observation - whether a job lasted a few hours or a few years, if it gave you an income that income is supposed to be reported to the IRS.

Pretty simple as to why they want to know - they want to make sure the foreign fiance/e won't need to use public funds when they arrive in the US. If your income is not adequate to ensure that, then you will more than likely need a co sponsor. So yes, they do 'check' in so far as you have to prove that you can support him - this happens at the interview phase. The information you supply about the employer on the G 325 A will obviously need to match what you state at the interview phase (within reason, in the event that you may change jobs).

Surely you learned that in your research (particularly if you perused the K1 guide on this site)?

thank you so much for your answers. There is a little misunderstanding. For my american fiance it is no problem to fill this out. I am the foreign fiancee. :lol: And i hardly worked since i stopped studying so i can visit him. and since i work for many language schools, sometimes for 4 different ones in a week, and then for some not for months, my list could be several pages long... And I think, does it really matter if i make it very exactly or can I just put a general list....

do i have to sign every page I ad at the bottom?

another question, did anyone ad his birthcertificate (again, I know that my us fiance has to do it) to the i-129f. Or should i not ad it?

The USC is the only one that attaches his or her birth certificate to the I-129F petition. The foriegn national will submit theirs at the interview.

There is no need to list every little part time job you held in your whole life. List the actual jobs that you have held not some afternoon work that you did.

In some cases the foriegn national may never have worked in the time period they are asking for, dont sweat it.

Forget about the G-325A and look at the visa application forms - DS-230, DS-156, DS-156k, and DS-157. Some of them ask for employer name and employer address and phone number. Decide how you're going to answer those questions and then be consistent on the G-325A. From your description I agree with others that there's no need for you to list each school you've worked at, sounds more like you're a self-employed freelance language teacher.

Once upon a time, not all that long ago in the overall scheme of things, the California Service Center was infamous for sending RFEs requesting the benficiary's birth certificate. It happened often enough that it was deemed prudent to send the birth certificate as part of the petition package. Haven't heard of any such RFEs for quite a while now.

The answer is a simple yes. I believe each page is fowarded to a different governmental body.

Sorry for the confusion, I did not realize you are the foreign fiancee. :blush:

As others have said, just be sure you are consistant on each form about what you list for employment.

I agree that the G-325A for the Petitioner must be accurate. They are probably more relax and do not check on the Beneficiary G-325A and the 5 year work history.

I too read it was best for us to submitt my Fiance's Birth certificate and did so with a certified translation. Why? Why not! She could supply it and needed to send me other papers for our initial submition of our I-129F.

PS. We just sent our I-129F in Friday 7-21-06 Garaunteed to be at NCS today and I did have them sign. We are going to remain very possitive people despite some of the news of slow processing. We are determined to be together and will do and wait for how ever long it takes! Otherwise I guess I start up business in Russia:))

Thank you very much for your help, you gave me great advice and I will check the forms I have to fill out in the future now. Hope I get it done right then. I am worried I will get a request for evidence which will delay my visa. Do you think the chance of getting an RFE are big?
