USCIS Mistake???

Hello everyone.

I am wondering if I can get my case expediated due to what I think is USCIS mistake, but before I do that, I wanted to hear all of your opinions and your recommendations.

My fiance came here on a j1 that has a 2-yr home residency. And, when we got engaged, we applied for a waiver (April 2009). I made an info pass appt. w/ our local office to ask if I could apply for the k1 while waiting for the waiver and the officer said, "no, that until we have a waiver we could not apply for another visa." Well, now i've learned that wasn't true and we could have applied and waited for both at the same.

Although, I have no proof of this because it was an info pass, I am wondering what my chances are of getting my case expediated.

It sounds like you answered your own question. From what you tell us there is no proof that you were given incorrect advice.

And even if there was, this doesn't seem to be a situation that would be expidited.

I would think that you wont get it expedited as there is not proof. You need something on paper or email that states that. Sorry to hear that you got bad advice from them.

Yes you can, I have....but your case involves one piece of undocumented misinformation so I highly doubt you'll get an expedite.

You can be expedited if you join the armed forces and get orders to ship out to the front lines.
