I guess its like the cases before the supreme courts--where they say who denotes obscene material--they said they know it when you see it. So could the same be said for hate speech--that you know it when you hear it?

Then again there was a riot and shooting on the subway system here in Atlanta when someone called another someone a Doughnut.* So just hearing it can't be the measure--but the intent behind the speech is the key.

*(The doughnut term referred to the assination of one of the shooter's friends earlier in the year at a doughnut shop, so the implication was I will kill you of the word doughnut, clearly intended as hate speech).
