Just when I thought all of the stress was so close to being over with, BOOOOM!!!! I get floored again today. I sent my fiancee everything she would need for her interview about the same time the big flood happened. I don`t know if it got washed away or what but she never received it. Of course all originals of everything was in it. I sent her the original I-797 just incase she needed it for anything even though I didn`t see where it would be required at her interview. Soooo I sent everything again, some of which had to be copies instead of the originals, including the I-797 which I didn`t think was a big deal because I didn`t think she would need it and even if she did she would have a copy. Well today I`m looking on the USEM website and see where it says that the original I-797 will be required at the port of entry when she comes here. I`m thinking bleep bleep beeepedy bleepp.... after I settle down a little, I think ok... another delay... sucks big time but not a real biggie I`ll just call the USCIS and get an original copy of the original?? something like that. Anyway, I call the USCIS and the guy says I`ll have to file an I-824 to get a copy of the I-797. I`m thinking more bleeps because of more delays by our good ol government but still not a real biggie, didn`t think much about the cost figured it would probably be free at the most $10 maybe $25 because after all I only needed a copy. WRONG!!!!! I went to download the I-824 and the filing fee is $340.00!!! ..... just to get a copy of the I-797!!!! Somebody please throw a big bucket of water on me because I know I must be having a nightmare!!! just gotta lov the gov... don`t cha

If you sent a fairily big packet with USPS expedited.. It may have gotten sent through customs.. I sent a letter envelope priority (maybe 1" thick). And then after about three weeks.. She did not receive it.. I talked to the local post office here,,, And a lady told me depends on the country for clearing customs... I mention PI and she said,, Oh yeah that will be awhile... Sure enough, after about 5 or 6 weeks the package showed up at her house.

How this is what happened with your package.

I'd be surprised if she really needs the I-797 (NOA1/NOA2) especially since these are documents that technically aren't even hers.

These are USCIS Notice of Action (First is receipt, second is Approval) regarding the US Citizens I-130 Petition requesting approval to have their Alien Spouse/Fiancée apply for a Visa.

Tge only time of heard of the NOA being presented at US Entry Point is when an Alien Spouse/Fiancée is visiting on a temporary non-immigrant Visa while the Immigrant Visa Application is processing.

I retained the original NOA1/2 for our cases and while she had scanned copies she was never asked for them.

The I-797c is needed for Adjustment of Status. Hopefully the xerox copy will do. We were not asked for the original at our interview and submitted a copy for the AOS packet.

Some VJers had to pay the $340 because the I-797c NOA2 never arrived in the mail and the USPS never returned it to USCIS.

We never needed ours and we already did AOS as long as you have copy just go with that until you find out otherwise. You don't need it at POE. You have the actual visa in passport :)

that really sucks; some of these fees just don't make sense. especially for that.

where did you see that she would need the original I-797? I haven't noticed that before.

Finally some good news though, I called Chicago O`Hare and the guy said they hardly ever even looked at the I-797 and that they would not deny her entry just because she didn`t have the original. He said they was there to help. I told him what the USCIS wanted for the fee to file and he was as surprised as me.

Glad the guys a O'Hare were helpful. My wife said they were really nice and efficient as they processed her quickly, I mean she was out the doors less than 30 minutes after getting off the plane and that was with a 2 yr old who also had to be processed in tow!

BTW, review the quote you posted, You're using the I-129f (Petition for Alien Fiancée), it's a different creature as while it isn't officially an Immigrant Visa it is one with "Immigration Intent"...
