USVI while adjusting status?

Hello everyone,

I need your words of wisdom. I called custom and border patrol and they said my husband who came via a K-1 will have no trouble going to St. Thomas, as it is still considered being in the U.S. I'm going to call again tomorrow, but want to know what you all thought about the fact that his I-94 expires 12/10/09 and we are scheduled to go 12/13-12/16/09. I'm wondering what exactly his status is after his temporary visa expires (which I'm guessing is 12/10/09 as the I-94 says) until he gets approved or atleast gets his advanced patrol? I'm going to have confirmation that we mailed in his AOS package and our marriage certificate, but now with the I-94 expiring 12/10/09 I'm nervous.

Do not set foot anywhere that is not a US territory, or travel on a boat outside the territorial waters. In other words, no island hopping. Board the place in the US, enjoy the time in the USVI, get on the place back to home.

Without the Advance Parole doc he cannot reenter the US. The K1 is a single use visa, it expired/voided when he used it to enter the US.

It may be a bit risky with out the AOS NOA1 receipt. Proof of mailing the package wouldn't count for anything as you can't prove what was sent.

I am sure other VJ'ers can add their experience/knowledge as well.

Thanks for your replies. I really appreciate it. I too would feel better if I had the NOA1 back before we went, but I think that's not going to happen. Why didn't I think this all out before I booked? I felt confident it was OK after talking to the Officer, but now with him kinda being in limbo I'm worried.

Anyone else have any experience or input??

I don't recommend this before you get NOA. All it takes it one fool to see the date expired and cause all kinds of hassles.

Does he have some other sort of ID besides a passport to get through security? If so, I'd use that instead of the passport.

Hey JG. I tried to get him a Florida lic. so we could just avoid his passport, but they won't do it in Florida. All he has is his Jamaican Lic. I called again and was told it's no problem, but I do have to wonder what I was thinking when I booked this. I mailed the AOS package last week, but don't think I'll get the NOA1 in time. Yikes!!! Thanks for responding.

You could try getting an Infopass appointment. If USCIS have received the AOS application and it is registered, then they should be able to issue you an AP or give you a letter confirming that he is in the system being processed in lieu of the NOA1. If they haven't receipted it yet, not sure what they could do to help but, it's worth a try, right? :)

Thanks Brit, but we leave Sunday so I have run out of time. What I was explained is that it's no issue at all about it being considered that my husband left the US and not being allowed to re-enter and his single entry visa. However, the concern is that unlike when travelling to one of the 50 states, we will be asked to prove we are citizens or legally in the US. I know he is here legally, but I'm prepared to face a hassle. I'll let everyone knows how it goes when we get back. Wish me luck!

I'm a bit late on the reply but bring your marriage certificate. We were married in the USVI and while going through immigration on departure from St. Thomas the officer asked to see it. Other than that it was smooth sailing.

Hello everyone and thanks again to everyone who replied. I just wanted to follow up on our experience, as we just got back. Going was no different than when we went to Las Vegas. My husband (the one that came on a K-1) showed his Jamaican passport to security and there were no questions asked. Then when we were leave St. Thomas we had to fill out the form that asks what are you bringing back ect. I'm sorry I don't know the name of that form. Anyways we were called to the counter and were asked if we were bringing any food back. We said just rum cake, which was no problem. Then came the part that got me really nervous. He scanned my passport and of course that was OK. Then he scanned my husbands and first tried to scan his Jamaican page then when that didn't work he scanned the Visa page he has and the first time it didn't take. I was sooo worried., but then he did it again and then just asked when we were getting married. I said we already got married and did he want to see our marriage certificate? He said no and asked if we sent off the paperwork to adjust status? I told him him we did the week before. Then he said congratulations and have a good flight. So I think there really is no problem going to the USVI. My husbands passport, well visa page scanned and there was no problem. Now with that being said I know others have had some issues and this is just my exeperience with one guy. If you go you may get hassled or have a person that doesn't know what theyre doing. I just wanted to let everyone considering this know that we went and had no problems at all and remember my husband came here 9/10/2009 and his passport says he's entered on that date and it's good until 12/09/09/ I was worried about that since we were coming back on 12/16/09, but thankfully we had no trouble at all.

While I'm here I want to say St. Thomas is beautiful but there is no nightlife, atleast during the week. We were really bored at night. PM if you have any other questions or concerns.
