We don't know what kind of visa will be appropriate to my sister...

2. Why is his diplomatic mission not doing this for her?

Maybe because she's already here in the US, she needs to go back to Philippines to process according to them...

There are several types of 'diplomatic' visas. Most have a derivative spouse category attached. Usually, it is enough for the spouse to take proof of the main visa, the marriage certificate, and pass the interview.

The person in need should post, and probably to a group other than this one.

I think the point of PPs posts is that if he is in the US on a diplomatic visa, regardless of its type, the Indian Foreign Office should be assisting him in obtaining a suitable visa for his spouse. Yes, she'll have to go back to India for it to be issued, but there isn't anything that the diplomat BIL should be doing other than contacting the appropriate department through the Embassy Liaison that handles these issues.

Maybe a more appropriate question would be when did your BIL marry your sister and was it in the US? This is the only reason I can think of that a Diplomat's spouse would not have been issued a diplomatic dependent's passport and accompanying visa. The Foreign Office take good care of their own usually, especially whilst on a foreign posting.

In short, the US Government are not going to issue a permanent resident's visa for his wife, because he is not there permanently. Unless there is someone on VJ who is a diplomat serving in the US who can tell us what visa type they hold (could be an L1, for example, but unlikely) then we're not going to be able to advise further as laymen.

Only the Indian Government can advise this person of what their protocol is, processing and cost wise, but I would expect it the visa itself to be fully assisted with and paid for. The only reason her husband is in the US is in service to the Indian Foreign Office, hence why they support their own. If the marriage occurred after his posting began, then there could be a loophole she falls through but I'd be very surprised. His now wife will be expected to step up an function as a diplomat's spouse, as she too will be representing the embassy during his posting.

Still baffled as to how a PI citizen is serving in the Indian Diplomatic Core though..

The BIL probably does administrative or IT work and OP thought that just because he works at an embassy, that he is part of the Diplomatic Corps.

I hope the OP comes back to clarify.

Agreed. no embassy would have anyone in a diplomatic core who was not a citizen of their country. they're civil servants when back home.

He cannot petition the USCIS for his wife to have any kind of residence because he isn't resident there. He is there as a guest of the US government.

So, either the dude is lying through his Filipino teeth and making up a completely ludicrous story; OR he works in the Indian Embassy as a non-diplomatic employee on a work visa --- also VERY , very unlikely.

I'm answering through your post; don't take it overly personally. I can't understand the urge to jump to calling people liars here now.

Don't you think it's possible that she got a word or fact wrong? Is there something wrong with giving the benefit of the doubt and just asking questions instead of diagnosing an entire case (which you admit is for a visa type you don't know about) based on a few posts that still don't give all the info?

There are a number of ways the BIL could have a 'diplomatic' visa and it's possible that he IS being served by the FSO for the gov't he's serving.. maybe the sisters were just talking and checking elsewhere out of curiosity?

L-1 is an intracompany transfer/manager.
