I'm a little confused.

I understood that your 129F/K3 applications first goes to Chicago, then to the National Benefits Center in Missouri, and then to the US Consulate in the country the beneficiary resides.

I thought that you needed the support forms, an immunization record, and of course all of the documents that you filed for your original I130 and I129 applications. I didn't think you needed the fingerprint police record and medical exam for the I129F/K3 application/interview that you need for the I130 application/interview.

I looked at the "Guide" on this site, but it seems to end when you send documents to your foreign spouse after receiving the NOA2.

Can anyone give me a brief step by step run down over what happens in the I129F/K3 process after you receive your NOA2?

I129 Approved (NOA2) 8/24/06 (41 Days)

Documents we have so far:

Criminal/police record check.

Immunization records/medical history (including negative Tb, HIV, syphyllis, etc).

Chest x-ray.

His birth certificate (long form).

Our marriage certificate.

My divorce decree.

Our passports.

Wedding photos, cards, credit cards, health insurance, evidence of legitimate marriage.

Notarized I-134 and supporting documents.

Notarized I-184 and supporting documents.

Five additional passport photos each.

1. MUST APPLY I-130 FIRST ALONG WITH OTHER DOCUMENTS.

2. WITH I-130 RECIEPT ALONG WITH OTHER DOCUMENTS MAY NOW APPLY K3 TO CHICAGO...

3. ONCE K3 IS APPROVED USCIS WILL FORWARD THE CASE TO NVC FOR FINAL SECURITY CHECK AND ASSIGNING OF NEW CASE NUMBER.

4. ITERVIEW IN THE US EMBASSY OF THE SPECIFIC COUNTRY.

- IN THIS INTERVIEW YOU WILL NEED ALL DOCUMENTS TO SUPPORT YOUR CASE.....PICTURES ,LETTERS, 1-134, BANK STATEMENTS. LETTER OF EMPLYMENT, TAX RETURN WITH W-2 ETC....

5. MAY ENTER THE US USING K3 VISA.

6. NOW MAY APPLY AOS TO ADJUST STATUS TO RECIEVE GREENCARD.

7. IF LESS THAN 2 YEARS WHEN GREEN CARD IS RELEASED THEN MUST LIFT THE CONDITION USING I -751 FORM.

8. ONCE LIFTED, THEN 10 YEARS GREEN CARD IS ISSUED.

9. EITHER YOU WILL RENEW YOUR GREENCARD FOR ANOTHER Y0 10 YEARS OR MAY OPT TO APPLY FOR CITIZENSHIP AFTER 3 YEARS OF INITAL GREEN CARD APPROVAL.....

NOTE: MUST INFORM NVC IF ONE WILL USE K3 INSTEAD OF I -130..THEY WILL JUST HOLD THE APPROVED I-130 TILL YOUR SPOUSE IS ALREADY IN THE STATES AND MAY NOW ADJUST STATUS BASED UPON THE APPROVED I -130.

There just seems to be a lot of conflicting information out there (in the guides, in immigration books, on boards) - some say only immunization/vaccination records are needed for the I129F/K3 (while a chest x-ray is required for the I130), some say police records needed for the I130 but not the I129F/K3. I'm so confused. Is there an official list somewhere I can look at so that we can start getting this stuff together now, rather than waiting for the package to arrive?

FYI, the affidavit of support for the K-3/K-1 visa I think is the I-134. The one for the CR1 is I-864.

Griffin has given you a good overview of the process. But I would also like to add that if the beneficiary enters on a K-3, you can continue with your CR-1 application instead of adjusting status. Your spouse can just come back to Canada for the CR-1 interview.

Yes, you will need both the medical and the police clearance regardless of the type of visa - CR-1 or K-3.

Below is a sample of the checklist that both K-3 and CR-1 applicants get. It is just a sample. It's not specific to Canada because I can't find one for Canada (nor do I have a scanner to show you mine). As Reba mentioned, the beneficiary will receive the checklist from the consulate if you're applying for the K-3. If it's the CR-1, you will get the checklist along with the DS-230 from the NVC.

Please note there are some differences between the K-3 and CR-1 checklist. For example CR-1, the beneficiary (from Canada) will need to send the documents to NVC along with the DS-230... one of the things not mentioned on the link above.

there is conflicting information because of different requirements in each country. The requirements in Canada for the K3 and the CR1 interviews are the same (except as noted, the different affidavits of support).

In Canada the beneficiary Must complete the medical exam before the interview, and that includes vaccinations/supplement and chest x-ray as listed on the panel physicians website. Cost varies depending which city you go to.

As a Canadian, most if not all of the vaccinations have been completed as a child so are not needed again. Most Canadians only need to have a tetanus/diptheria booster and titres to show immunity. Titres can be done at your own family doctor before the immigration medical exam. Results take about a week, so plan accordingly.

Police certificate is required for both the K3 and CR1 interviews. If you are in Ontario you can get the certificate at the Commissionaire's office, if you are in any other province, you can get it at an RCMP office and in some towns/cities you can get it from municipal police. Make sure to get the Canada wide name and birthday search. Fingerprints are not necessary unless the beneficiary has a criminal record.

Actually the Commissionaires are not for all of Ontario.. only for the GTA.. If you are elsewhere in Ontario, you still go to the RCMP...

You can start with 9 FAM 41.81 Notes, which covers K3 as well as K1. This will give you the basic framework for the K visas and should help you distinguish between K visa and immigrant visa requirements.

Within that framework there will be some variations in how things are done from consulate to consulate. Some consulates give good information on their web sites, others not so good.
