Help! Email from USCIS..Do we need to answer it?

Hello fellow members,

Pls..i need your urgent help. On Monday we just sent the RFE additional evidence to USCIS. They asked from me an Annullment Decree which I can not provide.

As u all know my kid's Birth certificate have the date and place of marriage but me and the ex were not married.

So i just sent them every documents I have which I think will help hopefully. SOme of the documents I submitted to USCIS are solo parent Identification from DSWD, Certificate of No Marriage showing I was never married to my Ex.and Certificate of Marriage 2009 showing I am married to my husband now(petitioner).

I got an email from USCIS just 5 mins. ago telling me that they received the documents we sent them on Monday( Nov. 30, 2009).and the process is now resumed.

We just found out last night that the father of my kids passed away on December 1. What shall we do now?

My questions are:

1. Do i have to call USCIS and let them know that the ex passed away and will ask an extension from them for me to get the death certificate of my ex?

2. Can i just email the USCIS? what is their email add? Should ijust reply to the email they just sent me?

Pls..i need ur help as i think the deat certificate will really be a big help since they are asking from me an Annullment decree.

I would appreciate it.

This happened after you sent them what they wanted.

Provide this information later at the NVC stage.

Only provide USCIS evidence when they ask for it.

1. Give them a call and ask, but more than likely you can provide this to NVC when they ask for documentation.

2. USCIS does not have an email address.

I was free to marry that is why i was granted the k1 visa .I don't think USCIS will be fooled if ever i submitted fake documents during my k1 application.The reason why i got the k1 visa is because they are convinced i was not married to my ex.

I disagree with you. Subsequent to receiving your K1 visa, you submitted additional documents to petition for your kids. This is where you ran into trouble with their birth certificates. The immigration folks were not aware of a problem until after you got your K1. Therefore, you cannot use the receipt of the K1 as evidence that you were free to marry. You gave them paperwork that said you were married after you got the K1. So the annulment would be proof that you were free to marry.

The immigration folks were not aware of a problem until after you got your K1. Therefore, you cannot use the receipt of the K1 as evidence that you were free to marry. You gave them paperwork that said you were married after you got the K1. So the annulment would be proof that you were free to marry.
Correct here, a death cert for Dec-1-09 is not proof that you were free to marry on the K-1.

Thank you for your reply. Like I said the Birth certificates of my kids submitted during my k1 application are the same birth certificates submitted on the I-130 application for my kids.That info was not hidden from USCIS.

We already submitted theRFE documents together with affidavit of explanation of the situation and documents to support .I just hope that USCIS will consider those and we'll see what happens?

The NSO CENOMAR should validate you were legal to marry.

Get the NSO death certificate as soon as you can. Get a couple originals as you will have to submit 1 to NVC later.

The NSO CENOMAR should validate you were legal to marry.

Get the NSO death certificate as soon as you can. Get a couple originals as you will have to submit 1 to NVC later.

Can't you just amend the birthcert of the kids?

Why did you let this legal documentation go on and on?

Ask a lawyer to help correct the birthcert.
