My fellow Vj'ers,

Good morning everyone,,would like to ask from ya'll once again.

As i have mentioned in my last post we just sent last Monday the RFE additional documents which is the Certificate of No Marriage since USCIS asked for an annullment decree. I can not provide this since me and the father of my kids were not married.

Last night I received a news which i am not sure if it is bad or good? The father of my kids had a car accident and was pronounced DOA .

I do not know if it's a good news or bad news for the processing of the kid's I-130 since he was never a good father being violent and irresponsible. Now my questions are:

1 . What are we gonna do? Should we call USCIS and inform them we will have another supporting document(death Cert). as additional evidence?

We are still trying to figure out for my Mom in Pinas to get a Death certificate of my Ex.

2. We already sent the Certificate of No marriage just 2 days ago? Would it be possible that USCIs will still asked for more evidence from us?

Plss... i really need ur help.Thank you in advance.

We are still trying to figure out for my Mom in Pinas to get a Death certificate of my Ex. That's not going to help your case. Since you submitted evidence that you were married, the RFE required you to send in evidence of an annulment. I understand that you were never married to the father of your kids, but you have conflicting documents on the matter. His death does not make this requirement go away. In the eyes of the immigration folks, you were married to this man. That means you cannot get married to another person while married to this man. You still need to show that you were not married to him and was free to marry the husband that is petitioning for you. That is the entire purpose of getting this documentation; to prove that you were free to marry your husband.

2. We already sent the Certificate of No marriage just 2 days ago? Would it be possible that USCIs will still asked for more evidence from us? Yes since you gave them conflicting documents. No one can predict how they will view the information that you provided.

[bThank you for your answer. Yes that is why i have to submit evidence or proof that I was not married to the ex through the Certificate of No Marriage.

Why would I be issued a K1 visa in the first place if Immigration found out that i was married before?(Which am not)

Also just wanna ask if is the death certificate not enough evidence for termination of marriage ?since there was no marriage at all?

How can i get an annullment now if i was for example married to the ex when he is deceased now? Is the death certificate not enough?

I know I made a mistake before but this is due to my ignorance which i admit.

Pls... any ideas wud be appreciated.
