GOOD day to all of you guys,, i am here again asking some information and help from all of you specially to those who really encountered the same problem as what my friend is facing now..

i have my new friend and she shared to me her live birth problems....here's the story

Her parents were not married and the time she was born she used her mother's surname but when she entered schooling she already used her father's surname,, her credentials in school and all the ID's she have are all with her fathers family name...............because her tatay file for Certificate of Acknowledgement stating that my friend is his daughter..

Then another problem is her gender..in her b-certificate it is written there MALE.....

Please guys help my friend about her problem......... what is the best way to solve this?

Does she need to have an attorney? or she will just go directly to the main office in Quezon city ?

hello. i had a problem with my birth cert too but i already sorted it out. i'd suggest that your friend first go to the local civil registrar where her birth cert has been registered. she might need a lawyer later. good luck.

Was your "friend" born a genetic male, or a genetic female?

On a serious note, this is a major change that will most likely require the assistance of an attorny in the Regional Trial Court. Have your friend get all documentation ready first, before "she" makes the change.

Since her father already filed a Certificate of Acknowledgment, your friend's use of her mother's surname in her earlier life and her father's surname later does not pose any problem. Just make sure that her NSO birth certificate shows the acknowledgment and/or amendment. The amended birth certificate with the acknowledgment will explain the discrepancy.

Republic Act No. 9048 allows the Municipal Civil Registrar to correct an entry in a civil register without need of going to court. Below are the pertinent provisions of the law:

SECTION 5. Form and Contents of the Petition. � The petition shall be in the form of an affidavit, subscribed and sworn to before any person authorized by the law to administer oaths. The affidavit shall set forth facts necessary to establish the merits of the petition and shall show affirmatively that the petitioner is competent to testify to the matters stated. The petitioner shall state the particular erroneous entry or entries, which are sought to be corrected and/or the change sought to be made.

The petition shall be supported with the following documents:

(1) A certified true machine copy of the certificate or of the page of the registry book containing the entry or entries sought to be corrected or changed.

(2) At least two (2) public or private documents showing the correct entry or entries upon which the correction or change shall be based; and

(3) Other documents which the petitioner or the city or municipal civil registrar or the consul general may consider relevant and necessary for the approval of the petition.

Your friend may need a lawyer to write up the Affidavit of Discrepancy and for notarization. Below is a sample of an Affidavit of Discrepancy (Date of Birth) and she can just change some of the details so that she does have to pay a lawyer to write it. If I have time later, I can even write it for her and post it here (if I don't forget!).

I stand corrected. I read the primer and it states that RA 9048 does not allow for corrections involving a change in sex. Although I am thinking that the provision applies only to those who had sex transplant and not honest clerical errors like in your case. I guess you will need to consult a lawyer for clarification.

WHAT CORRECTIONS CAN BE MADE BY RA 9048?

RA 9048 allows these corrections:

Correction of clerical or typographical errors in any entry in civil registry documents, except corrections involving the change in sex, age, nationality and status of a person.

(A clerical or typographical error refers to an obvious mistake committed in clerical work, either in writing, copying, transcribing, or typing an entry in the civil register that is harmless and innocuous, such as a misspelled name or misspelled place of birth and the like, and can be corrected or changed only by reference to other existing record or records.)

Hi,

Dapat habang maaga ayusin na ng friend mo yung BC nia, kasi ung mistake sa gender ay mahirap ayusin at medyo mahal din. Yung ate ko has the same problem with her, our town fiscal asked for 10,000.00 para mafix ung error na un. If Im not mistaken it has to go through judicial proceedings.
