I do understand that i have to get married before 90 days upon arrival and adjust my status.My question is that,before my K1 visa expired,should i have my green card in hand??What if my K1 visa expired and my papers still in process,do they send me back to where i came from?? :unsure:

hello. after your marriage, you will need to file for your adjustment of status ideally within the 90 days. some postings here says not necessarily within 90 days but others say better do it prior to the expiration of 90 days. (i filed mine within 90 days.) after you have filed for your AOS, you will be notified by uscis regarding your schedule for biometrics and interview with local uscis in your area. when immigration has approved your AOS, the green card will be processed. this will take quite awhile, roughly 90 days from the filing of your AOS. don't worry you will not be sent home while waiting for your green card. There is some gray area to the rules. After the 90 days you are out of status. When you get the NOA1 from applying for AOS you can use it for proof of being in the US legally.

Many K1 visa holders wait to apply for AOS for various reasons. These people are out of status and are rarely deported. The USCIS seems to overlook being out of status when you Adjust Status. Most K1 entrants do not come into contact with ICE. Like driving a car without a license, you can do it and may never get caught. You eventually go in and get a driver license and nothing happens.

I do not remember the user name but one VJer posted a topic about traveling in the car with her husband in Texas. They came upon a roadblock checking for illegals. Her I-94 was expired. Fortunately, ICE allowed her to apply for Adjustment Of Status and bring in the NOA1 before deporting her.

It is all but nearly impossible to have greencard in hand before your I-94 expires... the process simply is not that fast for a greencard application

To summarize: After your I-94 expires you will be fine if you have the NOA1 as proof of applying for the AOS . Until you receive the NOA1 there is a chance for you to be deported.

Thank u for all the input.It's highly appreciated :) Therefore,as long as i got married within 90 days and adjust my status before my I-94 expires, i will be safe. :D Even it will takes a couple of month for the approval of my green card, i will be fine.I will just bring my NOA1 from AOS all the time for some proof. :P Thank's again for the clarification.Godbless!
