ON December 2003, I was arrested for a non-traffic citation for retail theft as a juvenile (16 years old). I was asked to do community service The citation was withdrawn and the fingerprints taken at that time were shredded. The case was closed with exceptional clear.

I ticked YES to the following questions on the application:

Have you ever been charged with committing any crime or offense?

Have you ever been convicted of a crime of offense?

Have you ever been charged with committing a crime or offense?

I spoke to the police officer and he left a copy of the police report which i picked up from the receptionist. He gave me an envelope to seal it in from the station. Is this a certified copy cos it looked like its photocopied. I also wrote a letter to explain the theft stating I have been law abiding since then and it was a juvenile offense (is it necessary?)

I have my application ready to mail out, am now 22 years old. I have in my application the following:

Application & Biometric Fee : $675

Two photographs in envelope

Form N-400

Copy of front and back of Permanent Resident Card

A letter explaining the circumstance of arrest as a juvenile

Arrest Report & Disposition

I am nervous. Will I be denied ? What else do I need to include? Should I send it?

You did the right thing by disclosing it and it won't be a deciding issue in your case. You were a kid, doing something stupid, and it wasn't a horrendous crime. Relax.

You did the right thing by disclosing it and it won't be a deciding issue in your case. You were a kid, doing something stupid, and it wasn't a horrendous crime. Relax.

You are far better off to both report and explain it, if not, will haunt you for the rest of your life, and if found, could cost you your citizenship. Not because of the nature of this crime, but because you lied on your application.

If you have ever been arrested or detained by any law enforcement officer for any reason, and no charges were filed, send:

An original official statement by the arresting agency or applicant court confirming that no charges were filed.

If you have ever been arrested or detained by any law enforcement officer for any reason, and charges were filed, send:v An original or court-certified copy of the complete arrest record and disposition for each incident (dismissal order, conviction record or acquittal order).

If you have ever been convicted or placed in an alternative sentencing program or rehabilitative program (such as a drug treatment or community service program), send:

1. An original or court-certified copy of the sentencing record for each incident; and

2. Evidence that you completed your sentence: An original or certified copy of your probation or parole record; or

Evidence that you completed an alternative sentencing program or rehabilitative program.

If you have ever had any arrest or conviction vacated, set aside, sealed, expunged or otherwise removed from your record, send:

An original or court-certified copy of the court order vacating, setting aside, sealing, expunging or otherwise removing the arrest or conviction, or an original statement from the court that no record exists of your arrest or conviction.

NOTE: If you have been arrested or convicted of a crime, you may send any countervailing evidence or evidence in your favor concerning the circumstances of your arrest and/or conviction that you would like USCIS to consider.

Regardless, of whatever happened and/or when it happened, you still need to disclose such to the USCIS, as they will ask for such. And not disclosing of such is even more of a serious offence there, and can lead to a denial or worse consequences there.

The records have to be court certified and original (no photocopies), as mentioned above. Court-certified, meaning that they have to have a stamp, seal, or whatever else to say that the records are genuine. Any additional evidence about your court case may be needed too, as mentioned above, such as the evidence for completing sentences for the offence.

Notice of arrival a I-767c, surely you have already received these in previous stages of your immigration status. By receiving it with notice of getting your fingerprints, least you know you got that far. Your application can also be rejected for any of a number of reasons. Your interview is the final determination.

Your interview is the final determination.

THANKS. I don't think my applications will be rejected. That is the only thing I did, it is not even on my record and I disclosed it. Am sure people who have committed more horrendous crime have gotten their citizenship. I was a kid and I have learnt from what I did. God is with me and I am positive about it.

My oath of Ceremony is this month. YAY!

Congratulations, hope my step-daughter has the same success with a ticket for underage drinking. If she wasn't so hard headed at the time, would have gotten her off as a victim rather than a culprit, she was suckered into a party and served and more interested in protecting her "friends". She is grown up now.

Yeah, I really shake my head when I see our police department escorting a kid out of a store in handcuffs when swiping a candy bar, when we had a president that knowingly broke 576 laws of our US Constitution, just walk away with full retirement benefits.
