I am filling out the SS5 form for my wife. She is on a K1 visa.

Can someone tell me what box to check under "CITIZENSHIP"...?

Here are the choices....

U.S. Citizen

Legal Alien

Allowed To

Work

Legal Alien Not

Allowed To Work (See

Instructions On Page 2)

Other

technically, k1 fiance can not work unless they have an EAD. I thought it would be better to check "OTHER"

Anyone else came across this ...please let me know your opinion

FWIW, the SSA is NOT the USCIS... it is what you will need check...

If you are applying based on K-1 status and using your Form I-94 as proof of work authorization you should check "Legal Alien Allowed To Work." Even though the SSN card that will be issued should have “VALID FOR WORK ONLY WITH DHS AUTHORIZATION” printed on it, for SSN purposes SSA considers a K-1 work authorized until the Form I-94 is within 14 days of expiring.

We applied a week ago and checked the box not allowed to work since he does not have EAD. Is this going to present a problem later? We received his card today in the mail. It says Valid For Work Only With DHS Authorization. From what I have seen this is normal for K1s who have not applied for AOS yet. We will apply for AOS at the beginning of January. Just want to be sure that I do not need to be worrying about anything else before AOS.

That is the type of card a person assigned an SSN based on K-1 status should be issued. Didn't they print out an application to sign? That is what matters. That is what was entered into the system and the application wouldn't have been processed based on not being authorized to work, since you need a valid non work reason and documentation to prove it to be assigned a non work authorized SSN.
