Emergency Request - Social Security Retirement Income

I have read that often consular officers often refuse I-864 AOS's when the income listed includes Social Security Retirement income, because they mistakenly mix up Social Security Retirement income, which is a not a means tested benefit, with Supplemental Security Income, which is a means tested benefit.

If they refuse to accept the I-864, our visa will be denied.

I know the I-864 rules, on page 7, item 23, say to list earned and retirement income - but where can I find a specific law or rule that shows what is and is not a means tested benefit and that social security retirement income does count as actual income.

Our interview is on the 6th. Can anyone please help me so that I will be able to persuade the consular officer not to turn us away or deny our visa or refuse to even accept the I-864?

I read posts by "Nutty" that they refused her I-864 because of this.

Was not your I-864 already reviewed and accepted by NVC?

Because our petition was expedited, the NVC did not review our I-864 - it went straight to the Embassy (even though we'd already paid the $70 fee to have the NVC review it). So now, the Embassy is evaluating our AOS.

I am worried that they may not be familiar with AOSs because they don't normally deal with them.

I know Social Security Retirement Income and even Disability Income are counted as income - neither are means tested benefits, but where can I find the rule or law if I need it?

There is always a way to be honest without being brutal.
