So here's the case, my dad was co-sponsoring my brother's eventual k-1 visa. But it was sent back by the Guangzhou Consulate to USCIS. Then USCIS denied approval. My brother and his fiancee got into a big argument involving the parents and broke it off. I can say it was very ugly, even though it was over the phone. VERY UGLY. Now, I'm engaged and finally submitted my I-129F in September. My dad is gonna co-sponsor when it comes time since I'm a student (rough patch in the economy). Since my dad submitted a co-sponsor for my Bro's k-1 process, do we (me, my dad, and my bro) need to do anything for the previously denied I-129F? I'm thinking we don't since the co-sponsor is more of the NVC or consulate concern. And my bro's eventually got denied at the USCIS part.

hi! I;m sorry about your brother, It will really affect to you if your fathers income is below 20 thou. as I have heard from others. but you said it was sent to the Guanzhou consulate so it means your brother got the NOA 2, which means he passed. did his fiancee had interview from Guangzhou consulate? if she did, probably, the problem is not with your brothet but with the girl.

Since you don't give the reason for the denial, it's anybody's guess.

I suggest you provide more information if you wish a useful response: Was it denied due to financial reasons or something else? What? If it was financial ... e.g. they didn't accept your parents as co-sponsor, then I would expect the same might happen to you unless your parents financial situation has changed.

01/15/2009 -- she arrives in USA

01/16/2009 -- proposed! she says YES!!! :)

02/14/2009 -- 6 days of bliss in Walt Disney World (6mo given on I94)

02/23/2009 -- sent I129F Next Day Air

02/25/2009 -- NOA1

03/01/2009 -- Touched

04/09/2009 -- She flies to USA for 9 day visit (6mo given on I94)

06/20/2009 -- She arrives for summer visit (6mo given on I94, warned about too frequent visits)

06/30/2009 -- NOA2

Note: petition processed thru NVC and sent to embassy in about 1 week :o

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

10/21/2009 -- She returns to Poland :(

12/01/2009 -- Embassy interview -- SUCCESS!! :)

It has no effect on your petition or visa. You do notneed to do anything

If your brothers petition is dead then your father can co sponsor you without worry about the other petition. If he was still on the hook for your brother then he would have to make anough money to cover the combined households.

This will not be over quickly. You will not enjoy this.
