Hi! I am new to all of this, and I thought I knew which forms to file but after reading so many different forums my brain is trainwrecked!

I am the US citizen, and I married my husband on August 10, 2009!!! :) He is in the country on a student visa....however...he was placed in removal proceedings for failure to maintain status. (I know this raises a flag. However, we are absoutley in love and understand we will need to prove the validity of our marriage. Especially under our circumstances). I went with him to the first meeting with the immigration judge and absolutely nothing happened. We have another meeting scheduled for January of 2011....so we have some time.

Here is my main question:

* Based on the Visa Journey guide I should file an I130. Am I to file the I-485 also at the same time? For some reason, I thought I filed the petition I130 first, and after it was approved I thought I should file the I-485. Should I file all the forms as it shows: I130, G325a, I864, I485, I765, I131 as one complete package??

I am very grateful for any advice or help you can give me. I have already found a wealth of information on this website through the forums.

You got it as it looks like he may have married you just to get the GC and be able to stay in the US.

Why did he fail to maintain status?

I'd get a lawyer.

You got it as it looks like he may have married you just to get the GC and be able to stay in the US.

Why did he fail to maintain status?

I'd get a lawyer.

I hope I am replying right. That was my first post and this is my first reply! Please believe me, the thought did run through my head. We married sooner than intended....but are in this together with each other's hearts in mind. He failed to maintain status b/c of tuition and being removed from school. You suggest a lawyer? We have discussed a lawyer.....but haven't made any final decisions.

Any other input will be greatly appreciated on the lawyer suggestions???

IMO anyone whose case is not straightforward (yours is definitely not) should at LEAST have a consultation with an EXPERIENCED immigration attorney. It won't hurt you and they will be able to answer all of your questions.
