have not filed taxes in 2 years

Timeline

Hi. Our I-130 was approved October 7, '09, and I know soon it will be time to file the I-864, and one for a co-sponsor as well. I have been a stay-at-home mom for the 2007, 2008, and 2009 tax years. I did work 2007 and 2008 but earned only about $3,000 each year, and did not file a tax return for those 2 years, and will not file one for this year either. What do I do? What do I need? (So I can go ahead and request whatever I will need and have them ready to mail out without waiting when the time comes)

I could be wrong, but I believe you need to file taxes for 07/08 even if you only made 3,000 each year, and you will have to pay some penalty for filing late. http://www.irs.gov/businesses/small/articl...=108327,00.html is the best source of info in this case.

With a zero bracket amount (standard deduction) at $5700 plus personal exemption of $3650... for many single people, taxable income does not come into effect until you reach a total of $9350 (higher if qualified for HOH).... So it is very possible the OP was not required to file a tax form. She certainly could have, particularly if she qualified for some refundable tax credits or had withholdings to recapture

If it were me, I would meet with a tax preparer and get some advice. I think you are probably due a refund of some sort. And, I do believe you need them for your filing.

Timeline

Each year, on the 1040 there is a table that specifically states whether or not you have to file, based on your earnings each year. OP, you need to look at the instructions for each year and find your situation on that table to find out if you need to file. So just google 1040 2007 for example to find that year's form.

If you find you were not required to file and you decide not to file at this time, then you need to attach a note to your I-864 stating why. For example: I did not file a tax return in 2007 as I was not required to do so as I only earned $ 3000.00.

Now, as someone else also mentioned, you may be due some refundable tax credits, that's another kettle of fish but certainly worth looking in to.
