Citizenship for my son

I just want to double check that My son who is just 18 has to wait for 5 years of being here (he came on a K2 visa)to apply even though I can apply after 3 years of marriage, is that correct?

Yes, if the child was under 18 when you become a USC then the answer could be different..

FWIW, you cannot become a USC until the latter of 3 years marriage or 3 years as a Permanent resident... based on your timeline, it is your residency date that would be the final "trigger"

Yes, if the child was under 18 when you become a USC then the answer could be different..

Yes, and for the son, it's not five years of being here, it's five years of having lawful permanent resident status. The time he spent here before his adjustment of status was approved doesn't count toward citizenship.

See the N-400, Part 2. An alien can become a citizen no earlier than the date when he or she can check one of those boxes. As the spouse of a US Citizen, Muuuuah should be able to check box 2b after three years of having the green card, and the son should be able to check box 2a after five years of having his green card.

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Timeline

We are in the same boat as you, while my wife and I were married for well over three years before her daughter turned 18, it was the delay in getting their conditional green cards that shot our daughter barely over 18 years of age. So she has to wait the full five years plus we have to pay an additional $675.00, plus make three more long trips for her biometrics, interview, and the oath ceremony.

But for us, it's only time, money, and inconvenience to get it done.
