:help: I'm new to this site and was hoping someone could help me out a little. My husband is from Morocco and is here on a student visa. We were married last month just after his OPT expired. He was told that he only has 60 days after the expiration date to figure out what he is going to do. We have just begun to fill out the I-130 and get all of our stuff together. If he goes out of status will he be able to stay here since we are already legally married? I was under the assumption that after he is married his visa is no longer good as a student visa and he needs to apply for adjustment in status, which we are about to do. I'm wondering if his is in a limbo stage and if he will be able to stay here in the USA while everything is getting processed. I don't think I can do everything if he has to go back. Can someone answer my questions or direct me somewhere it might say what happens? Please help!

08/24/06- I-130, EAD, I-485 recieved

08/28/06- NOA1 for I-130, EAD, and I-485

09/01/06- Recieved boimetrics appointment letter

09/07/06- Biometrics appointment

10/24/06- Recieved letter for initial interview

11/21/06- EAD approved

11/27/06- EAD Recieved!!!!!!!!!!!!!!!

11/30/06- Touched- NOA for EAD sent

12/01/06- I-130 and I-485 Touched

12/20/06- Initial interview

12/20/06- APPROVED!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! (4 months!)

12/27/06- Recieved NOA2 for I-130

12/27/06- Recieved welcome letter

01/03/06- PERMANENT RESIDENT CARD RECIEVED!!!!!!!!!!!!!!!!!!YAY!!!

09/18/08- Sent I-751... hopefully I did it corectly!

03/19/09- Recieved letter stating I-751 transfered to CSC

To the best of my knowledge, If you are a U.S citizen, and you apply while his visa is valid, he doesnt have to go back.

Also, just becuase he is married he doesnt automatically loses his student visa.

Basically the same process everybody else goes through but you do not need a Visa to get in.

But he is possibly out of status and potentially deportable so file asap and get him back in status for sure.

I take it his I-94 had d/s on it?

File for AOS as soon as possible and he can stay legally. If he needs to work or travel, you need to apply for EAD and Advance Parole.

I would not risk the AP.

Maybe a small risk, but....
