I guess I'm a little out of the loop. Did you not have to request a waiver for past criminal convictions? I thought that was standard. :unsure:

If it is standard to have to file the waiver for all past convictions then the embassy shouldn't have granted it on the first place. Seriously this is nuts. Denied at POE after being approved....thats horrible. Now have to file the waiver and wait a year because it has to go through Montreal which we all know is backlogged. I'm so sorry you have to go through this.

So sorry to hear about this cody. I can't really believe it either... I think everyone will be a little more on edge when trying to cross with their visas after hearing about this experience.

Maybe this will just be a temporary hurdle for you to jump over on the road to being with your future spouse. Hopefully things get straitened out sooner rather than later! I wish you all the best!

Poprocks is right. It's the dept of homeland security that gets the final say. I do remember reading that on the sheet they give you when your visa is approved. What sucks is he probably gave up his job and home and began to plan his life. They truly are in complete control of our lives.

I wonder if the guy was just having a bad day...or if it would have happened with anyone. Regardless it is very sad and I don't even know what I would do.

Krikit is right...this could have happened, if either the conviction was never disclosed or discussed at interview...and came out at POE...or Embassy let it fall through with no waiver....

There may be a miscommunication somewhere....and the full story is not known...either way...it sucks to get all the way to the boarder, with your visa in your hand and be turned away...with nothing to really go back to cause you were moving!!!!

I know that I didn't sigh a big fat huff of relief until I pulled out of POE and onto the I190......

That's really funny. Considering they can seriously ruin your life. Or at least make you feel like it is.

I tried to enter the US on Nov 27th and got denied.

I was in Secondary for almost 4 hrs and was in confinement the last 2 of those 4 hrs. I was denied because of an offense I had back in 1982, which the person that interviewed me said that he would let it go and if some of you remember, we had to go sit down for a bit, well that was the reason why. Well anyways the CBP said that he contacted the Montreal Embassy and had it changed, so my K1 Visa has now been canceled and I was given an I-601. This really bites, cause now it's going be over a year if it gets approved and I can't enter the US til I get a waiver.

I just sent off an email to Montreal to try and get some things cleared up on this matter, hopefully they'll reply back.

I will give you updates as to how we are progressing.

I hope that everyone else doesn't have this problem at the POE.

Cody, so sorry to hear about your experience! All that work to get the visa... :-(

Man oh man. I just read this thread and am shocked and aghast...

I've never been a suicidal type, but my god...going from such a high, after the long, arduous process of USCIS / NVC / Consulate...to the utter low of facing another year and a half, PLUS the same process again... I don't know if I could handle that.

Omg, this is horrible. I'm so sorry :( I'm really scared now, and know I'll be having a heart attack at POE... lol

Best of luck to you, and I too really hope this gets resolved for you quickly. I can't even imagine what I would do if that happened :( I don't even want to think about it.

It's true that they control this, no question about it.

However I believe they can only have as much control as you let them. If they had turned us back at the POE I would have been a bit mad, but onward!

I mean that in no way to detract from what cody is going through - but just to hopefully put a little perspective on this. We are not travelling from a war torn country where our lives depend on the good mood of a POE officer.

I'm just shocked that a single call from the POE can completely nullify half a year's worth of successful processing through other government organizations...not to mention all the money involved.
