If the sponsor is expected to earn under the 125% of poverty level this year (below 19K for 2 people) then you will have to get a co-sponsor regardless of what they earned in previous years. They are concerned that the sponsor can support the intending immigrant AT THIS PRESENT TIME... Sounds like you are close so you should have a co-sponsor lined up if I were you...

Not sure what there is to ask... The requirements are very set... You MUST earn 125% above poverty level to sponsor an intending immigrant.. in 2009 that level is $18k and some change... if you do not currently (meanin in 2009) earn that, then you have to have a co-sponsor who does earn 125% of poverty level for his/her family size plus 1 (the intending immigrant)... With the 864 you have to submit 2008 tax returns, a letter of employment that states what you earn and details of your employment and 6 months of pay stubs ... Given the current economy they are looking at the income and that you can afford to support the intending immigrant and that he/she will not become a charge on the system...

You can also use assets to offset the difference... For example, if you make say 15,000, the difference between that and the 125% poverty level is like $4,000... You have to have the difference ($4,000 x 3years ) or a total of $12,000 in liquid assets... This would also meet the requirements...
