I had a question for you guys not about me but about my cousin, Can you be put on AP in NVC? and how long does it usualy take?

I believe it's normally I-129 form's that are typically put into AP. So K-1 and K-3 petitions can be put into AP at the NVC stage. AP for CR/IR-1 filers...is unheard of so far I believe.

LoL sorry if my question is dumb is just that my cousin Strated trying to bring her husband here A year before me. And she is still in NVC i i dont understand why she is still there, I only started 3 months ago and im already in NVC and Inshallah im almost done. So this is why i asked i thought maybe something happened and they put her in AP.

What visa did she file for her husband? K-3 or CR/IR-1? The type of visa is more than likely the determining factor...or your cousin should call NVC and quick to find out the status of her case. And AP has no end, it can go on forever...

And on a more cheerier note, the expedite request has been sent. Here goes nothing!

And im thinking umm no usualy people finish with NVC within 4 months But o well. lol

It may be time for her to get her congressman involved. When did she file, get NOA1, NOA2?

Hm...so she sent the AOS package, and she sent the DS-230 which was compiled by her husband, she's paid both fee's I assume...maybe she received an RFE. Okay, my best advice is to get her to call NVC again and to ask to speak to a supervisor and see if you can find anything out from there. Good luck.

Hello fellow NVC crowd,

I just called the NVC automated system and found the recieved my case from USCIS on Dec 4. I will send them the email copy of the ds 3032 on Monday, I will also send in hard copy as I have seen that the email system is not really up to date. I already have the aos $70 already and still working on the IV fee of $400 but by the time it comes around I should have it. I have all of the paperwork done and ready to go. With a little luck I will not be hit with any RFE or AP and should have a 6-8 week pit stop at NVC before my wife's interview.

And_ Sam, Yeah it is hardly to keep waiting and waiting and waiting to be log in failed. I always do that almost everyday but since I got an RFE I stopped to logging into the website. Although I sent back the RFE to the NVC it delivered 12/03/09. So I'm hoping that sooner I have the case complete? GUyzzz is it necessary to photo copy the NBI aside from the original one? Thankz GOD BLESS and Hope our journey in NVC will not take long.

Ever since I turned in my RFE I LIVE on the stupid website.... The AVR stated that they received my RFE checklist letter on 12/02/09..but I can still log in..

you think so Bern? It was my understanding that you could be put into AP anytime during the journey. Even in NVC. Egypt is well known for being put into AP and AR after the interview, even to the point where it is returned to the NVC for additional AP. I think it just a matter of it is being questioned at the Dept of State level or Embassy level.

You should post that question in the MENA forum Muslimah, you would probably get better answers there!!

I'll use Paris Heart for example, when her K-3 was approved, her I-129 form (which made the petition a K-3) was put into AP, but she was still about to proceed in the processing of her CR-1. With this in mind, I don't believe I-130 forms can go into AP during the NVC stage. This belief is backed by the fact that I have NEVER heard of it.

However, once your interview is conducted, whether you're K-1, K-3 or CR/IR-1, if they are not convinced and need additional time, then off to AP you go. :S

I know that we applied for the K3 also and it was sent to the embassy the same time that the CR1 was sent to the NVC and we haven't heard a thing about that one...So it's either in AP-land or maybe lost in the mail to the embassy? It's a better visa in the long run, you will not have to go through AOS and dish out another $1010 and with the CR/IR-1 the beneficiary becomes a permanent resident upon entry and can work right away.
