I'm not quite sure where to put this topic.

Is it possible (likely) for my wife to get a visitor's visa to the USA? (shes from Ukraine)

We have filed for her to immigrate to Canada, but the process can take 12 - 15 months.

She has already visited Canada and the UK, and returned. (no overstays)

I want to have her visit me in the US this winter, is she likely to get a visa, or will we just be wasting our time trying?

She has a job & apartment in Ukraine.

Would the CO realize that she has zero interest in staying illegally in the US, as she is already waiting for Canadian papers?

Has anyone had experience in this situation?

i my openion no body is getting a b2 visa out of ukraine unless you have some major strings to pull in the top of the gov't it is a total wast of time and money!!!!

i just tryed 2 times for my lady and wasted 262 and they did not even look at any support documents!!! they asked questions related to k1 visa!!!

what a crock of ####### it is!!!

Why not apply and see?

Because it will waste time & money for her to travel to the consulate, so I'd like to think that it has a reasonable chance of success before suggesting it. Not to mention that you have to make an appointment a month in advance...

Did they put a stamp in her passport "Visa refused - US INS" or something like that?

Your situation isn't the typical one seen here on VJ, so feedback might be thin.

Every visa applicant is assumed by the USCIS to have immigrant intent. From what I see here on VJ it is tough for Ukrainian citizens to get tourist visas for the US. She has to show strong ties to home (property ownership, job, family ties, etc.)

Boiler is right, the only way to know for sure is to apply.

I've filed for a spouse application in Canada.

Hmm, I'm sure that it would be asked in the interview, about her status.

The question would be - what possible motivation would the wife of a Canadian citizen have to overstay a US visa? :unsure: She will be getting Canadian landed immigrant papers in 3 or 4 months, and a Canadian passport in a couple of years, so why would somone possibly want to live as an illegal in the US? :wacko:

Sadly, the way it looks like this is going we will be spending our tourist $$$ in Mexico instead of the USA. :(

I doubt they would think about living illegally in the US, just that the typical things they look for that would cause an a tourist NOT to overstay (property, job, spouse, kids back home) would all be absent. The fact that she would soon be in Canada legally probably wouldn't figure in - it would just make too much sense :D

Unfortunately US border authorities view everyone coming to the border and applying for admission as a potential immigrant - even Canadian citizens who only want to visit :) so the onus would be on your wife to provide strong proof that she has ties elsewhere that make her seem less of an immigration risk. You are a snowbird visiting the US during the winter? You are normally resident in Canada? She might have a chance of a visa if your wife is able to provide proof of both your strong ties to Canada, her strong ties to the Ukraine and her intentions of immigrating to Canada which is already in process - eg. copies of her immigration application to Canada. It is a different situation than is normally encountered here but I think there might be that possibility if she is armed with very good evidence of ties to two other countries. Why not also send her a letter of invitation to join you at such and such an address while you are visiting in the US while on a vacation, and include the specific dates you are asking her to come. Be realistic - don't ask for 6 months - try for a month or 6 weeks. If she can provide proof of her ties to the Ukraine (ie letter from employer, translated into English, proof of accommodation liabilities in the Ukraine, etc.) along with copies of her Canadian immigration records it might be possible.
