Hello,

I was wondering if anyone knows anything about getting a divorce from my husband that I married in Ghana. We got married in May of 2009 and we STILL have not even filed the papers! While this may not seem like a big deal to some, this is NOT what my husband and I agreed upon. At this point, I am done! Along with some other information that I found out...I want a divorce and I don't even want to start or complete the filing process.

I live in GA. Does anyone know if I can file for a divorce on my own from here? Can he get an annulment in Ghana? Can I get one here? I mean we've never lived together, no kids, no assets, nothing.

Any help would be appreciated.

Sorry to hear things haven't worked out for you. Respectfully, however, this is an immigration forum and not a divorce one. I'm sure that there are members in GA and Ghana respectively who could advise you but your best course of action would really be to seek advice from a divorce attorney local to you.

Hey SunDrop...thanks for the reply.

Yes, I do realize that this is an immigration forum and not a divorce forum (lol). Hence, that is the reason I initially signed up to track my journey in the immigration process in the first place.

I was just wondering if anyone else (since everyone in here has "International Issues") had experienced this or knew of any helpful information...that's all. I noticed someone a few other posts about divorce and the members were ever so helpful in giving their feedback on what they've experienced or just simply gave their opinion. I was just trying to reach out to those who may have information that could be helpful.

I believe you can initiate a divorce on your own. Consult a divorce attorney.

03/27/2009: Engaged in Ithaca, New York.
08/17/2009: Wedding in Calcutta, India.
09/29/2009: I-130 NOA1
01/25/2010: I-130 NOA2
03/23/2010: Case completed.
05/12/2010: CR-1 interview at Mumbai, India.
05/20/2010: US Entry, Chicago.
03/01/2012: ROC NOA1.
03/26/2012: Biometrics completed.
12/07/2012: 10 year card production ordered.

09/25/2013: N-400 NOA1

10/16/2013: Biometrics completed

12/03/2013: Interview

where are you in the process. has your I-130 been approved? has you husband has his visa interview? given that you were married internationally, you'll have to find out your state's laws w/ regards to granting divorce in absentia. A divorce attorney will know best. As for your aborted visa journey.... you should make sure that USCIS, NVC and the consulate knows that you no longer wish to pursue the petition/visa. (The number of agencies you should notify depends on where you are in the process.).

You can FILE TODAY at the county courthouse.

If it's an uncontested divorce, you'll need to get a certified 'waiver to appear' document with his signature and some official seal on it, filed AFTER the initial filing.

BUT - these things vary, by COUNTY and STATE. IMO - the 'one to befriend' is the COUNTY CLERK that handles 'family law' - go find his/her office, sit down with one of their assistants, ask about paperwork requirements for 'that county'. They can show you templates, examples, any forms they accept.

FACE TO FACE is best, IMO - get to the County Courthouse, asap.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

just go to a divorse lawyer and he will tell you how to handle things. your husband dont even have to be in the united states to divorse him.

i think if the US recognizes ghanian marriages as being legally binding then you can just initiate divorce through a local attorney and that's it. sorry to hear that, hope things work out.

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....
