Yeah that's how I understood it. That's what I thought I posted origionally lol. She is going to get an RFE for the divorce papers. I may be loosing my brain.....

you have 11 months to think about this. You can not file for anything right now anyway.... It won't be easy to put up with someone you are no longer in a relationship with two more years (hoping your waiting time for ROC will be couple moths). As long as you are honest I don't see any reason for denial.

If you finalize your divorce at the end of 11 months just file for waiver with all the evidence proving your marriage was based on good faith.

If you guys have change of a heart, there will always be an explanation over bumps for marriages. You will wait for your 90 period and file together.

As far as the taxes, I believe you need to file as "married" regardless you are filing jointly or seperate You are not divorce yet. If you would like to file for jointly you can also do this as well. I am not sure about the details but in TX if you lived at leat 6 months at the same address you are eligible to file for jointly anyway whether you are divorce or not... If he doesn't want to deal with it that is fine, you can still do seperatlely.

I wish you the best of luck but please give yourself a break and let this to have a rest. You have lots of moths to think thru and I don't see any reason for you to loose your GC. Divorce waivers are usually subject to an interview and their process takes longer but majority of them o.k at the moment as long as marriage was legimite.

The laws may have changed, but FYI here is what my attorney told me when I filed for divorce in NC back in the 90's: There is no divorce police coming around to check where you live. In other words, whatever date the parties claim to have separated is the date of separation.

LOL at least you have a good excuse! I have nothing but my ability to explain things in a foreign language only I can essentially understand hahaha.
