Two year requirement? Say it is not so.

Timeline

Someone from this website who recently got a K-1 visa approved told my fiancee that we must prove that we have know each other for at least two years or else her visa will be denied. This is the first time I have ever heard anything like this and I believe this is simply wrong information. Please comment on this. Thank you.

The requirement is to have physically met within the 2 years prior to filing. You could have known each other for years and years prior, but have to have been together in person within the last 2 years. good luck on your journey :thumbs:

No. But it is necessary that the American be able to read instructions, understand them, and follow them. Or pay someone to do it. I seriously question how anyone "from this site" could have received a visa for their fiancee and failed to do all three. Or four.

You are required to have met, in person, your fiancee at least one time within the past two years. This means you can meet a person for the first time in your life TODAY, shake her hand, get your photo taken and propose marriage (about as fast as I just typed that) and file the petition this afternoon. It also means that if the last time you were with your fiancee, whom you have known for 10 years, have visited 30 times and have 3 children together and communicate with daily, was in 2007, you need to go visit her again before you file.

I suggest you get any immigration related advice in the public forums, not in personal messages or other communications. Ridiculous statements such as you have been told will be immediately corrected by knowledgeable people in public forums.

Immigration is complex but not impossible to do yourself. I suspect that an unusual choice of vocabulary, misunderstanding by the 'listener' or even forgetting how the adviser actually qualified for a K1 (if they'd known their fiance for more than 2 years AND had been together physically within the past 2 years) could have contributed to the misinformation.

You're right to have checked it out because the responsibility is on you to make sure that you adhere to the proper procedure, and not just depended on someone else (whether a friend or a lawyer!) Only you care the most about your petition and its success. And welcome to VJ :)

Thanks. She was given misinformation. I was 99% sure this was misinformation, but your comments helped us both rest assured and feel confident that that we are on track to getting our K-1 visa.
