Okay, so my DH is not the best at all this so I have taken responsibility of filing the I-30 myself. Background: I am a Malaysia citizen, came here on an L-2 visa because my dad was contracted here for a job, switched to a F-1 student visa when I headed to college and was about to age out. Met the hubby in college and dated for 3 years. Went through a depression and my visa lapse and my grades didn't qualify me for it anymore. Got married August 10, 2009

Here are my questions:

Will I get denied based on the fact my visa is lapsed? (it lapse in May of 2008)

Will I get denied because I accidentally put the departure date of my L-2 visa (so looks even worst!) on my I-30?

Is there anyway to fix this? :unsure:

I sent in bank statements, apartment lease with our name together, and our marraige certificate

So you are in the US now correct? Did you file the I-485 to adjust your status or just the I-130?

You 'accidentally' put your L-2 departure date, meaning you put that you had left the country?

A little more information would be helpful

So you are in the US now correct? Did you file the I-485 to adjust your status or just the I-130?

I just filed the I-130. Should I have filed the I-485?

I did put my departure date in there because I left after high school to Europe for a month and came back. I basically fill in all the blank spots. But Yes, I put that I left the country. But I am till here.

Then you have a problem. USCIS thinks you left the country and you are currently in the US. You should have filed to adjust status. You are currently on a path to interview in your home country.

You should never lie on any forms. I suggest you call USCIS now and correct this problem. If they do not let you, I suggest the USC cancel's the petition and files again with your correct information.

You also need to file the I-485 to adjust your status, not sure when you'd like to do this however

Visas are applied for and granted to people living outside the US so they can enter the country. This is useless to you since you are already in the US

Good luck sorting this mess out. I suggest you post on the Adjustment of Status forum so you can get better answers. 1st thing is to fix the mistakes on your forms. 2nd is to file for an adjustment of status. If you don't, you'll be forced to leave the country to interview and your illegal presence in the US will come back and bite you in the #######.
