I thought I share this with you all.

Oct. 2000 - USC parent petitioned for married son in Viet Nam. Wife and three children are derivative beneficiaries.

Aug. 2001 - I-130 approved

No communication for 7+ years

Feb. 2009 - AOS & IV fee letter received. Two of the children had aged out and CSPA did not help.

April 2009 - I-864 and DS-230s submitted

Sept. 2009 - PD became current

Mid Nov. 2009 - Visa interview

Nov. 25, 2009 - Visas issued for son, son's wife, and son's youngest daughter (who turned 21 on Oct. 1, 2009 - so CSPA does not apply since the PD became current before her 21st birthday).

April/May 2010 - Immigrate to US (anticipated).

congrats to your family for the approvals! I'm helping my stepdad file for his married son (and family). We filed in Dec 2008, so hopefully it'll be approved soon too. The oldest son is 11 so hopefully everything will be approved so he can also migrate!

[*]08-xx-2009 - 4th Trip (4wks)

[*]10-07-2009 - AP 91 days - Result: APPROVED!!

[*]10-31-2009 - POE: Detroit, MI

[*]11-18-2009 - Social Security Card

[*]11-20-2009 - Green Card

[*]01-21-2010 - Driver's License

THE NEXT STEPS...

[*]02/07/2011 - Renew Vietnam Passport

[*]07/30/2011 - Process of Removing Conditions Begins

There shouldn't be any problems. The best scenario is that it takes a few years to approve the I-130 which allows for a more generous application of CSPA than if the approval was quick. If USCIS had taken 4-5 years to approve the I-130 for my brother instead of 10 months, his other two kids would not have aged out. Expect not to hear anything for years. We did not receive any communication from the government for 7 years.

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )

4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

One more thing, the US Consulate in HCMC will not schedule interview until after the PD becomes current. The NVC had sent the file to the Consulate in July.
