Hello everyone,

I am wondering if my initial I-130 petition package will cause problems to using the electronic process after the package reaches NVC? I was reading the instructions and noticed that you are not supposed to send any hard copies of documents for the process, I sent the DS-230 part 1 with the petition! I am wondering if after I OPTIN for the electronic processing, will I have to resubmitt the DS-230 via e-mail, or will just the documents requested after OPTIN be required to be e-mailed? I am asking about the DS-230 specificaly because it is listed in the NVC e-mail kit for using the electronic processing!

if you sent any 'original documents' that are NORMALLY sent in during NVC processing, then ya, you might have some issues -

but - is more along the lines of 'document acceptance' issues.

There is 'evidentiary chain' on documents - the DS-230 that you submitted on initial I-130 submittal may or may not be stripped out during USCIS processing - depends on how the clerk 'feels' that day when your packet is reviewed.

That 'evidentiary chain' on 'original documents' starts at NVC - there is no guideline for any documents to 'carry along' from USCIS to NVC. It might happen, you could get lucky, but ....

IMO, you will still have to follow the 'submittal guidelines' at NVC - for either Paper/Postal or Electronic - I NEVER READ of any I-130 petition 'going fast' at NVC because all documents were in the casefile prior to NVC processing.

So - if you want to go Electronic @ NVC, ya, you need to send in SCANNED documents to NVC via email, after OPTIN.

I've a wiki page here - have a look ? http://www.visajourney.com/wiki/index.php/...onic_Processing

Pay particular attention to the 'DS-3032 kit' - as it starts 'electronic payment processing' (a different thing ) , which, IMO, you really want. It also is 'best indicator' (payment status ) for 'when' to submit documents at NVC.

Good Luck !

For short answer :D

NO, if you want to go electronic at NVC, having any original documents 'follow along' with the casefile, at I-130 submittal time, is NOT a problem.

You just need to OPT IN, and go. Assume the prior submitted DS-230 doesn't exist, act as if it didn't exist.

PPS -

Front Loading of an I-130 was supposed to cover the evidence of bonafide marriage documents, never any NVC-gathered documents. I hope you had 'other evidence' on the I-130, for that bonafide marriage stuff.

esubmitt the DS-230 via e-mail, or will just the documents requested after OPTIN be required to be e-mailed? Sorry - these are one and the same - recheck the document list of NVC processing, you'll see the DS-230 in the list.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Thanks for the answer Darnell,

I read the document list you mentioned and saw the DS-230 on the list, that is why I was concerned about my early submittal of the DS-230 Part 1. I was hoping I had not caused a delay or issue to our case by sending in the DS-230 prematurely! I will list my package inventory for my I-130 petition that I have submitted. If you see anything I should have not sent already or anything that you think should have been submitted with the petition, please let me know!

Package Inventory Sheet:

1) I-130 Petition

1) Application fee $355.00

2) Passport Photos (Wife)

2) Passport Photos (Husband)

4) G-325A, Biographic Information (Wife)

4) G-325A, Biographic Information (Husband)

1) DS-230 Part 1

1) Copy of Passport, Biographic Page (Wife)

1) Copy of Passport, Biographic Page (Husband)

1) Copy of Chinese ID Card (Wife)

1) Copy of US Drivers License (Husband)

1) Birth Record, Official Translation (copy) (Wife)

1) Copy of Birth Certificate (Husband)

1) Divorce Record, Official Translation (copy) (Wife)

1) Copy of Divorce Papers (Husband)

1 Copy of Chinese Visa (showing entry and exit stamps from passport) (Husband)

1) Copy of Marriage Record, Official Translation (copy)

8) Pictures of marriage, honeymoon, and time together with her family.

1) International money transfer receipts from husband to wife

Again, thanks for your help! Yes, I have about 600-700 pages of web chats, phone bills to her phone in China, hotel receipts, airline ticket receipts, 300+ pictures, I did not send these yet. My wife will take these to her interview and present then or sooner if they request the evidence!

600-700 pages of web chats, phone bills to her phone in China, hotel receipts, airline ticket receipts, 300+ pictures which is considered 'evidence' for marriage stuff, and you didn't send it in. Your choice, of course.

re: your document list - as long as 'all' of her original documents were photocopies, you are ok.

re: DS-230 Part I - sorry, it's Parts I and II for an I-130, and it's to be submitted at NVC processing time.

When you get an NOA-2, wait 2 weeks, then call NVC to 'register' - they'll send you the 'DS-3032 kit' back via email - follow the steps in my wiki entry if you want to 'go electronic' at NVC.

and ... :D :D :D

Disregard this DS-230 that you've sent in. Seriously, don't muck about with it. Prep another one. Be Ready.

Darnell,

Thanks for all the help! I guess I sorta dropped the ball on the bonafide evidence part, :bonk: I don't know why I was thinking that was material she would have to have at the interview! I had done a lot of reading about interviews and the documents the beneficiary takes to the interviews I thought that was when the receipts, e-mails, chat logs, etc. came into play. I was so worried about having the forms complete and correct, I did not even think to include those items in my I-130 package! I guess all I can do about that is to have a very organized and detailed " evidence of bonafide relationship " satchel file prepared for her interview! I will read the guides you mentioned and " slow my roll " down so I don't make another mistake! Thanks :D

GUZ is a tough consulate, high fraud...

Evidence on Initial Submittal is mondo cool - for one big reason -

it travels with the casefile.

The IO / ConOffs review it prior to Interview Day.

The USCIS people see it also.

Don't sweat it , for now - just have a solid pack o stuff for her, on Interview Day.
